The February 2016 Bar Exam: The Changing Face of the Florida Bar Exam and Why It Is Time to Get a Florida Bar Exam Bar Professors’ Tutor

Yesterday, the Florida bar exam results came out and, as we know, it was the lowest pass rate in recent memory. For February 2016, the pass rate was 58.4%. Last year the pass rate was 64% and in February 2014, the pass rate was 71.8%.

We have never seen the pass rate of law schools like we saw yesterday. Out of 11 schools, 8 schools were 56.5% or below. Florida Coastal and Barry Law Schools were 32.7% and 35.9%, respectively, an outrageously low pass rate. The non-Florida law schools were 48%.

Why were the scores so low?

There is a combination of reasons. First, the MBE. We have seen changes in the last couple of bar exam cycles that have caused the mean average to now drop to 135 nationwide. With Florida’s standard to pass the MBE at 136, it is extremely hard to get that magical 136 when the mean average is just 135. It makes the repeat bar exam taker’s task almost impossible without help from a Bar Professor’s Tutor. Secondly, let’s look at the Florida section of the bar exam. Everyone was surprised by the subject matter. We had not had a criminal law/procedure subject tested in years as an essay subject, but we just had back to back criminal law and procedure essays. We then had a Federal and Florida constitutional law essay – which tested commercial speech – which again has not been tested as an essay subject in recent memory. Then finally, we had an entire essay on commercial paper. Although we have seen commercial paper as a small component of a contracts essay, we have never seen an entire essay devoted solely to commercial paper.

We are seeing the changing face of the Florida bar exam.
