The July 2013 Bar Exam: The MEE and UBE

More and more states are turning towards the MEE or UBE Programs conducted by the National Conference of Bar Examiners for their state’s bar examination.

The National Conference of Bar Examiners offers six 30-minute questions per administration. The state elects which of the six questions they wish to use. Jurisdictions that administer the UBE use all six MEE questions as part of their bar examinations. The UBE also has 2 MPTs.

The Multistate Essay Examination (MEE) is given in 30 jurisdictions now. Minnesota is the newest state to use the MEE starting in February 2014. States that have the MEE include Arkansas, Connecticut, Washington, D.C., Illinois, Iowa, Kentucky, Mississippi, New Mexico, Oregon, Rhode Island, South Dakota, West Virginia, and Wisconsin.

The Uniform Bar Examination (UBE) is given in 13 jurisdictions now. Minnesota and New Hampshire are the newest states to use UBE starting in February 2014. States that have the UBE are Alabama, Arizona, Colorado, Idaho, Missouri, Montana, Nebraska, North Dakota, Utah, Washington and Wyoming.

Minnesota is listed as both a MEE and UBE state.

The July 2013 Bar Exam: Illinois and Changes in the Passing Scores

Previously, Illinois had announced that there would be a change in the minimum passing score to take effect in two stages, for July 2013 and for July 2015 bar exam scores. Fortunately, for those taking the July 2013 bar exam for Illinois, the board of admissions has decided not to change the minimum passing score for July 2013. The board of admissions had earlier announced that effective July 2013, the minimum passing score would be a combined written and MBE score of 268.

Right now, the minimum passing score is a combined written and MBE score of 264 and will stay that way until July 2015.

Instead, beginning with the July 2015 bar exam, the minimum passing score will be a combined written and MBE score of 272, an increase of 8 points.

The July 2013 Bar Exam: The Florida Essays and the New Subjects on the Florida Bar Exam

For the July 2013 bar exam, I had my students in Florida review the new subjects on the bar exam. We knew that since the Florida Bar Examiners did not test any new subjects in February, the likelihood of one of the new subjects being tested was possible. We went over secured transactions, commercial paper, dependency and juvenile delinquency.

We finally hit pay dirt in July when the Florida Bar Examiners ended up testing secured transactions in the first essay, as part of a cross-over question. It was at the tail end of a long common law contracts essay. The secured transactions issue concerned equipment and who had priority between the bank and the lender. It was a pretty straight forward issue and, hopefully, those in Florida recognized the issue and answered it.

I’ve been told that the Florida results will be coming out September 23rd.

It is August 14th, do you know when your bar exam results will be released? Starting the end of this month, many state bars will release their bar exam results. North Carolina is usually the first state to release its results and Kansas follows shortly thereafter. Some of the states with early bar results in April are Arkansas, Oklahoma, Idaho, New Mexico, Iowa, Oregon and Florida.

The Failure Rate of the California Baby Bar

As you know, it is crucial that you pass the California First Year Law Students’ Examination as soon as possible and within the allotted three times or you will have to retake your law school classes.

The statistics for the California First Year Law Students’ Examination are very telling. Let’s look at the categories and the overall statistics of the June Exam.

For those students from unaccredited correspondence schools: the percentage of passing is 23.8%

Distance learning schools: the percentage of passing is 21.5%

Unaccredited fixed faculty: the percentage of passing is 21.6%

CA schools approved by the ABA: the percentage of passing is 11.8%

CA accredited but not approved by the ABA: the percentage of passing is 12.8%

Total percentage of passing is 20.6% The First Time Taker Pass Rate is 20.5%, while the repeat taker rate is 20.7%

As you can see, the percentage rate of failure is an astounding 79% with only 21% passing. You read that right – the statistics are pretty incredible and it personally makes me wonder why the schools are not working with the students and making all efforts to help the students pass the exam. Yes, we can go back and forth about the quality of the students, but I do put the blame squarely on the schools that take tuition from students and allow scores like this for their student body. A student who wants to be a lawyer should have every opportunity of success.

Students need to ask themselves if they really want to be a lawyer and what it will take to become one. The first hurdle must be accomplished – you must pass the California Baby Bar Examination. You need to reflect on what it will take to get over this obstacle.

Secondly, a student needs to pass the CFYLSE as soon possible so that you do not have to retake classes. That is why it is important that you get a bar tutor to help you pass the California FYLSE. Passing the California First Year Law Students’ Examination

It is imperative that you pass the California Baby Bar as soon as possible and within the allotted three times or you will have to retake your law school classes.

First let’s discuss the grading of the California Baby Bar.

An applicant’s raw multiple-choice score will be the number of items answered correctly. Multiple-choice raw scores will be converted to a 400-point scale.

An applicant’s assigned grade on an essay question can range between 40 and 100. Total raw essay scores can therefore range between 160 and 400 points. Total raw essay scores will be converted to the same 400-point scale of measurement as that used for the multiple-choice portion.

An applicant’s total score on the examination is the sum of that applicant’s converted scores on the multiple-choice and essay sections. This step gives these sections equal weight in determining the total score. Applicants need a total scaled score of 560 or higher to pass the examination.

From the adjusted scale, an applicant needs to pass the California FYLSX by a score of 70%, which is why many students fail the exam.
However, an applicant who is required to pass the First-Year Law Students’ Examination will not receive credit for any law study until the applicant passes the examination.

An applicant who passes the examination within three consecutive administrations of first becoming eligible to take the examination will receive credit for all law study completed to the date of the administration of the examination passed, subject to any restrictions otherwise covered by these rules.

An applicant who does not pass the examination within three consecutive administrations of first becoming eligible to take the examination but who subsequently passes the examination will receive credit for his or her first year of law study only.
Students need to pass the California baby bar as quickly as possible so that you do not have to retake classes. The California Baby Bar Results Out on Friday

For those students who took the California FYLSE in June, the results will be mailed out on Friday, August 9th. As you already know, the pass rate is very low – approximately 80% of the students who take the exam will fail the California Baby Bar.

The July 2013 Bar Exam: The Bar Exam is Over, Would You Have Done Anything Differently?

The bar exam is over and the waiting begins. Before you get your results, you may want to reflect on how you may have done your studying differently. Law schools and bar exam companies never fully prepare you for the “experience” of taking a bar exam. It is something you have never done before and you go into the unknown, always hoping you did what you needed to do to pass the bar exam. I had one student tell me that she didn’t “get it” until she sat at the bar exam and the proctor gave the signal to begin.

What would you tell a fellow student who is gearing up to take the February 2014 bar exam? Would you tell that student to study harder or differently? Would you tell your friends to start studying earlier? I am also convinced that the way you studied for the bar exam will reflect the way you approach your job as a lawyer. To be a good lawyer you must put your sweat, time and effort into your cases – this is what separates you from all the other lawyers out there. Can you say that you put it all on the table when you sat for the bar exam? Will you put in the same effort you did studying for the bar exam when you get your bar license?

The July 2013 Bar Exam: The Bar Exam is Over, The Waiting Begins

The bar exam is over and the waiting begins. North Carolina is usually one of the first states to release its results in approximately a month. Then the states begin to roll in, one after another.

For now, take the time to relax and have fun. You deserve it. There will be enough time to fret and wait for your results.
