Bar Exam Results for July 2012: Maryland and Texas to Come Out this Week

Both Maryland and Texas are scheduled to release their bar exam results this week. Both states will release their bar exam results for July 2012 on Friday, November 2nd.

Good luck to those waiting for release.

We are still waiting for word on Washington, D.C.’s release, although a reader has said that the results letters have been mailed out.

Bar Exam Results for July 2012: Michigan Has Released the Names of the Successful Applicants

Michigan sent out the results letters to its bar applicants last Thursday and Michigan has now released the names of the successful applicants on its website.

Bar Results for July 2012: Massachusetts Statistics by Law School

Massachusetts has now posted the names of the successful applicants of the July 2012 bar exam results. The statistics for the applicants are: for first time takers, the pass rate was 85.3%. The second time taker pass rate was 41.4%. The third time taker pass rate was 56.3%. The fourth time taker pass rate was 25% and the fifth time or more pass rate was 16.7%. The total pass rate was 81.1%

Boston College: first time taker pass rate: 91.8% Total pass rate: 90.8%

Boston University: first time taker pass rate: 92.1% Total pass rate: 92.3%

Harvard: first time taker pass rate: 97.4% Total pass rate: 97.4%

Bar Results for July 2012: Massachusetts and Michigan

Massachusetts and Michigan have already sent their results letters out to the applicants who took the bar exam in July 2012. On Monday, October 29, 2012, both states will post their results on line. Massachusetts also posts its statistics by first time, second time and multiple takers. Looking at the numbers, you can really see how the repeat takers statistics start to tank the more times they take it. That is why it is important to get a tutor so that you don’t become one of those multiple taker statistics. Massachusetts also posts the statistics by law school – which is a great indicator of the school’s commitment to bar passage.

July 2012 Bar Exam Results: 7 States Still Have Not Released their Bar Exam Results

As of today, there are seven states that have not released their bar exam results. California, New York, New Jersey, Rhode Island, Maryland, Texas and Washington, DC are the last hold-outs for release of bar exam results. Massachusetts and Michigan have sent out their results letters and will be posting the names of the successful applicants on Monday.

For those who have failed the bar exam, start your preparation for the February 2013 bar exam. Make your study plan and follow it to the letter. It’s time now to forget about what happened on your last bar attempt and start anew. For 2nd, 3rd, and 4th time takers, you must obtain a bar tutor to get you over the top.

July 2012 Bar Exam Results: Ohio and Georgia, Alaska and Washington, DC

Ohio has released its bar exam results this morning. The names of the successful applicants are posted on its website. Georgia will post its names of successful applicants by 4:30 pm today.


Alaska's bar exam results came out yesterday. Out of 102 applicants, 70 students passed for an overall pass rate of 69%. The number of first time takers was 76, with 59 first time takers passing for a first time taker pass rate of 78%.

We are still waiting for word from Washington, DC for their release date.

Why Do Law Students Fail the Bar Exam?

Most law students fail the Bar Exam for three major reasons:

1. They revert back to bad writing habits developed in law school.

Under the pressures of the bar exam, many students revert back to bad habits. These bad habits allowed them to graduate from law school, but will be the kiss of death on the bar exam. Some of the bad habits include, not organizing your answer, no line by line analysis and not answering the call of the question.

2. Poor Preparation and Time Management.

Many law students start their bar preparation entirely too late, leaving most in a rush mode. For the upcoming February 2013 bar, your preparation should start immediately after you receive notice that you must retake your exam. You should allow yourself 5 to 6 hours per day for studying. But more importantly, studying correctly is the key. You need to write and answer many essays and MBE questions. Your answers must be evaluated by a private tutor.

3. They don’t really believe that they will pass

You must have a belief that you will pass. Get rid of all negative thoughts, people and things. You must truly believe that you will pass. You must say this every single day prior to the bar and you must have the confidence to succeed.

The California Baby Bar is Today

Today the next California First Year Law Students’ Exam will be given.

As you know, it is crucial that you pass the California Baby Bar as soon as possible and within the allotted three times or you will have to retake your law school classes.
The percentage rate of failure is an astounding 81% with only 19% passing. You read that right – the statistics are pretty incredible. The first hurdle must be accomplished – you must pass the California Baby Bar Examination. Secondly, a student needs to pass the CFYLSE as soon possible so that the student does not have to retake classes.

Bar Exam Results for July 2012: DC, Alaska, Maryland, Ohio, Georgia and Michigan

This week there are a number of states scheduled to release its bar exam results for July 2012. Washington, DC may release this week and Alaska is set to release its bar exam results on October 25th. Friday is going to be a busy day for bar exam release: Ohio, and Georgia are all scheduled to release the bar exam results for their states on October 26th.

In Maryland, Out of State Attorney results will be mailed on October 26, 2012 and General Bar results will be mailed and posted on November 2, 2012.


We are still keeping an eye on Michigan. There is no definitive word yet.

The February 2013 Bar Exam: Organization and Analysis: Essay Writing for the Bar Exam

Once you read the fact pattern, you will organize your essay, then you must analyze.
This is where you make the outline looking for issues. Look back to the fact pattern for facts which should be used for applying the law and then you can apply the facts to the law.

The February 2013 Bar Exam: Know the Black Letter Law

In addition to putting in the study time, you need to learn how to maximize your study time. How do you go about getting the biggest bang out of your study time?

First, build a good, solid foundation of the black letter law. In order to have a good foundation, you must review each bar exam subject. Go through each subject, one by one and absorb each subject as best you can. As you go through the subject, make sure you understand the basic law before you move on.

To build a foundation of the law, you need to break the subject areas into more manageable components. Break your subject into topics. And go through the elements of the topics of each subject.

What I mean by that is to take a subject, like Torts. Then break the Tort subject down to topics, i.e. Negligence. Do you know all the elements of negligence? Do you know the elements of battery? You can outline it and/or make sure you know it by heart before you move on. You can do that memorization by reciting it or writing it down without looking at your notes or outlines.

Once you feel you know that topic, do a few essay questions and some MBE on that topic just so you know you have it.

Don’t scatter-shoot your studying. Learn the topic thoroughly before you move on to your next topic in the subject area. Don’t go through the topics of the subject areas all at once, i.e. don’t go through battery, assault, false imprisonment and not know each one by heart. Stop at battery, recite it, do some MBE and then move to assault, and false imprisonment and the other topics of Torts. Do this for every topic in every subject. You do not want to read your subject outlines like a novel.

Read, learn, recite, memorize, test yourself and move on.

The February 2013 Bar Exam: The Study Plan

Why a study plan? In order to pass the bar, you need two things: time-management and discipline. Sticking to a study plan will conquer both requirements. Thorough preparation is the key to passing the exam and having a plan in place will allow you to manage your time and using your discipline to stick to the study schedule. For a plan to work, you have to address your learning style as well as the substantive areas you will be tested on.

For your study plan, you should first start with relearning and reviewing the outlines with some practice questions thrown in and as you pick up the pace, you’ll reverse it and do more practice questions and essays and only use your outlines for clarification on questions you get wrong or confused about.

In the beginning, you are going to struggle with the voluminous materials, but keep at it and keep pushing the pace. It’s like training for a race. You first have to struggle through the repetition until it starts feeling right and you start performing at your optimal level.

Be realistic with your goals and your study habits. For example, you can’t go throughout the entire day with no lunch or no exercise or no breaks because you were unrealistic in the time aspect of your plan. You have to write a study plan that suits you and your personality without slacking off.

Don’t ignore your weak areas or your strong areas. You may not need to schedule as much time in your stronger subjects, but review them as consistently as you do all the other subjects. You may not need to read or reread the outlines of your strong subjects, but during those time periods, practice your questions. You may need those extra points on the bar. For your weaker subjects, don’t spend too much time obsessing on your lack of knowledge or take away from other subjects you also need to study; and do not ignore your weak subjects. All bar examinees have weak subjects. Again, spend time on those subjects as you would other subjects and just keep practicing. You’ll be surprised at how much you really do know in those weak subjects.

Passing the Florida, New York or California Bar Exam When English is Your Second Language

I have been receiving e-mails from applicants who are having trouble with the bar exam because English is their second language. Also, we have had a multitude of people from foreign cities read this blog.

How should a person prepare for the Florida, New York, or California bar exam when English is their second language.

1. First, and for most, obtain a private tutor to evaluate your essays. Working with a tutor will dramatically improve your chances of passing.

2. Write, write and write some more. An applicant needs to learn to write on the Florida bar subjects to both understand the law and to develop a writing structure.

3. Memorize the law “cold” because you have a built in language barrier. You do not have the time to think about the law, you must know it.

4. Start early.

Implementing the above will help you be successful on the Florida, New York or California Bar Exam.

July 2012 Florida Bar Exam Results: The New Tested Subjects for the Florida Bar Exam

Now that the Florida bar exam results for July 2012 have been released, the repeat taker must gear up for taking the Florida bar exam again in February 2013. But, the repeat bar taker has another obstacle to overcome in February 2013. The Florida Bar Examiners have clarified some subjects and added a few more subjects for Florida repeat takers to get ready for. These new changes will make the Florida bar exam exceedingly challenging for those repeat bar exam takers. Instead of looking at past exams for predictions on the testing subjects, no one can forecast how these changes will affect the Florida portion of the exam.

The main concern for the students I talked to was Article 3 and Article 9 of the UCC. Unfortunately, many students did not take the two subjects during law school and must learn it anew. Additionally, the repeat bar taker did not learn the subject through their bar review course and are now facing the prospect that they will have to learn the two subjects, along with prepping to take the Florida bar exam again. There is Only One Week Left until the California Baby Bar Exam

There is only one week left until the next California First Year Law Students’ Exam. The test will be given on October 23, 2012.

As you know, it is crucial that you pass the California Baby Bar as soon as possible and within the allotted three times or you will have to retake your law school classes.
The percentage rate of failure is an astounding 81% with only 19% passing. You read that right – the statistics are pretty incredible. Students need to ask themselves if they really want to be a lawyer and what it will take to become one. The first hurdle must be accomplished – you must pass the California Baby Bar Examination. You need to reflect on what it will take to get over this obstacle.

Secondly, a student needs to pass the CFYLSE as soon possible so that you do not have to retake classes. That is why it is important that you get a bar tutor to help you pass the California FYLSE. July Bar Exam Results: The MBE Exam

I have talked with many students this bar exam cycle about their MBE scores. Many students I talked with failed the MBE while passing the state portion of their bar exam. The MBE is always difficult because you have to get the right answer or you get no points. Across the board, whether you are from Harvard or from a third tier score, contracts and property are one and two for the hardest subjects of the six – and where most students have the most difficult. Torts is ranked as the easiest subject in terms of how many questions students get right nationally.

For those who failed the MBE exam, evaluate your scores carefully. Were your scores low in every subject or did you do well in some subjects and not well in others? This evaluation will determine how you should study of the February 2013 bar exam. If you have across the board weakness, then you have problems with the analytical portion of the test – you are not understanding the strategy of elimination. If you scores reflect an up and down weakness per subject matter, then you need to concentrate on those weak subject while not forgetting to work on your stronger subjects.

Repeat Bar Takers: Don’t Let the Odds Discourage Your Goal to Pass the Bar Exam

As a repeat bar taker, you are clearly at a distinct disadvantage for passing your next bar exam.

For example, the pass rate for all repeat takers for the California July 2010 bar was a shocking 22%. In California, 2,478 applicants were repeat takers for July 2010 and only 545 applicants passed. In Texas, only 46% of the second time bar takers passed the July 2010 bar and only 45% of repeat takers in Massachusetts passed in July 20010.

It’s time for all repeat bar takers to start studying now for the February 2013 bar exam. The “key” to passing is obtaining a private tutor. Do not do what you did before – taking a commercial bar course a second time will not help you. Make sure you have a plan in place to ensure your success. July 2012 Bar Exam Results: Colorado has Released its Results

Colorado bar exam results for July 2012 have come out. The pass rate was 80%. The University of Colorado had a 89% pass rate for first time takers, and the repeat takers passed at a 33% rate. The University of Denver had a 91% pass rate for first time takers and the repeat takers passed at a 33% rate.

July 2012 Bar Exam Results: Colorado and Washington Bar Exam Results Come Out Today, Pennsylvania comes out on Friday, Michigan is Set to Come Out Soon

Colorado’s Bar Exam Results for July 2012 and Washington’s Bar Exam Results for July 2012 are set to come out this morning. Colorado’s bar exam results will come out no earlier than 10 am.

We are still keeping an eye on Michigan.

July 2012 Bar Exam Results: The MBE: A Passing Score

The Multistate Examination is hard. You have to have a game plan when you go into the exam.

Here are some suggestions:

Reading a Question

Because of time constraints, you will have time for only one reading of the fact pattern. Do not read the fact pattern as a novel.
You must read carefully and actively to spot signal words and legally significant facts. Pay attention to the bar examiners’ particular use of language and look for the following as you read:

1) Relationships between parties that signal the area of law and legal duties: landlord/tenant, employer/employee, principal/agent, buyer/seller;
2) Amounts of money, dates quantities and ages;
3) Words such as “oral” and “written,” “reasonable” and “unreasonable,” among others;
4) Words that indicate the actor’s state of mind. These are crucial for Criminal Law and Tort questions. Look for such language as:

• Intended
• Decided
• Mistakenly thought
• Deliberately
• Reasonably believed



Never Assume Facts

The bar examiners carefully construct MBE questions to contain all the facts you need to answer the question. You must rely solely on these facts and no others, to answer the question. Of course you may draw reasonable inferences from the facts but you cannot fabricate your own or create “what if” scenarios.


Stick to the Law

You must apply the rule of law to the facts without hesitation or equivocation. You cannot get emotionally involved with the parties or substitute your instincts for what you know is legally correct. Don’t think someone is guilty when the call of the question say he is not. That is not what the question is asking you.

Bar Exam Results for July 2012: Colorado, Washington, Michigan, Louisiana, DC, Virginia, Arizona and Pennsylvania

This week there are a number of states scheduled to release its bar exam results for July 2012. Colorado and Washington are set to release their bar exam results on October 11th. Friday is going to be a busy day for bar exam release: Louisiana, Virginia and Arizona are all scheduled to release the bar exam results for their states on October 12th.

We are still keeping an eye on Michigan and Pennsylvania. Neither state has given a definite date. Pennsylvania has scheduled a release mid-October.

Washington, DC will release its results on Oct. 25th.

Bar Exam Results for July 2012: It’s Time for a Private Tutor

The time has come when you check the bar examiners website, look up your number and see that you have failed the bar. Shock, disappointment, sadness, angry, embarrassment – you run the gaunlet of emotions. What do you do now?

Spend a little time with your emotions. Get them all out – have yourself a cry, throw your books across the room, but then there comes a time when you pick yourself up, dust yourself off and try again.

You must take the bar exam again – do not take too long to get over your emotions. Have your cry and move on. It’s time to refocus again on the bar. I’ve had students tell me that they have studied the hardest they had ever studied for anything in their lives for their first bar exam. That’s probably true, but that’s why it’s time to examine how your study. Look at your scores in depth. The analysis of your scores will determine how to prepare a strategy for yourself as your prepare for the next exam.

Florida repeat bar exam takers have a leg up on many states because of Florida’s early release date. The results for the July 2012 bar exam came out in mid September. You have had time to process the fact that you did not pass the Florida bar exam. Now it is time to take action and make sure you pass the February 2013 bar exam.

Florida Bar Results: Passing the Bar Exam

California, Florida and New York are all weighing cases of illegal immigrants who have passed the bar exam and are seeking a law license. Here is the latest case coming out of Florida.

Florida's Supreme Court on Tuesday grilled attorneys on the implications of issuing a law license to an undocumented immigrant and law school graduate who passed the Florida Bar exam after disclosing he was in the United States illegally.

As 26-year-old Jose Manuel Godinez-Samperio of Mexico watched the proceedings from the gallery, one judge accused the Florida Board of Bar Examiners of putting the state in an awkward situation.

"It seems very strange," Justice R. Fred Lewis said in chastising the attorney for the board on why it allowed Godinez-Samperio to take the bar exam in the first place if it was not prepared to admit him when he passed.

"You bring a person to the edge and you push him off the cliff ... . I'm just at a loss as to how the board put the state in this kind of position."

The case is the latest chapter in a battle that pits the administration of U.S. President Barak Obama, which has a new policy of granting temporary legal status to millions of young illegal immigrants, against states that seek to crack down on illegal immigration within their borders.

Known as "deferred action for childhood arrivals," the policy shields illegal immigrants aged 15 to 30 from deportation for at least two years and allows them to obtain work permits.

In August the U.S. Justice Depatment told California's high court that it should not allow an illegal immigrant, Sergio Garcia, 35, to practice law in the state even though he passed the bar exam and has the backing of state officials.

At Tuesday's hearing, several Florida justices asked if the Justice Department should be consulted in this case, too. A similar case is developing in New York, though it has not yet gone to court.

Godinez-Samperio passed the bar exam last year after disclosing that he was an undocumented immigrant and obtaining a waiver from the board's 2008 requirement to show proof of residency or citizenship.

After he passed the exam, the board asked the state's highest court to rule on whether undocumented immigrants should be allowed to legally practice law in Florida.

During oral arguments on Tuesday, Justice Charles Canady repeatedly referred to a 1996 federal immigration law, suggesting that it precludes Godinez-Samperio from practicing as a lawyer.

"Doesn't the board have a responsibility to follow the federal law?" Canady asked board attorney Robert Blythe. The law prevents state and local agencies from issuing professional licenses to unqualified immigrants.

But Talbot "Sandy" D'Alemberte, the attorney for Godinez-Samperio, argued that portions of the law apply to state agencies but not to the court.

Other justices inquired how Godinez-Samperio would legally work even if he had a license. D'Alemberte said he had applied in August for "deferred action."

Godinez-Samperio legally entered the country with his parents when he was 9, but the family overstayed its tourist visas.

His father and mother, both professionals in Mexico, took farming and factory jobs while Godinez-Samperio became an Eagle Scout, high school valedictorian and a graduate of Florida State University's law school.

Minnesota Is the Next State for Release of Bar Exam Results for July 2012

Minnesota is scheduled for release of its bar exam results for July 2012. On its website, Minnesota is giving a window of 6 days to wait. Minnesota has informed its students that the bar exam results will be released between October 5th and October 10th. Hopefully, for the students waiting, it will be closer to October 5th than October 10th. What a way to increase anxiety for the students waiting.

July 2012 Bar Exam Results: Nevada to come out tomorrow, Delaware to come out on Thursday, Minnesota to come out soon

It is the beginning of October and many states will be releasing their bar exam results for July 2012 this month. For this week, Nevada bar exam results for July 2012 will come tomorrow, Delaware will come out on October 5th and Minnesota will come out between Oct. 5th and October 10th. Those states are coming out imminently.

States that are releasing their bar exam results for July 2012 in October, include Colorado on October 11th, Michigan, will come out around October 12th, Louisiana, D.C., Virginia, Arizona all are releasing their bar exam results on October 12th. July 2012 Bar Exam Results: MBE Question Discussion

Many of our students told us that the MBE questions for July 2012 were pretty hard. As we hear from our students and others who took the July 2012 bar exam and have gotten their results, we are learning that many applicants did fine on their state portion, but did not do as well on the MBE section of the bar exam

While we wait for jurisdictions to come in with their bar results, we thought we would post an MBE question to analyze together. As part of our effort to bring information to our readers, we invite all readers of this blog to try answering the MBE questions we post. Here is the first one:

Dave, a federal lawman, suspected that there was illegal gambling in his jurisdiction of West Undershirt, Kansas. He suspected Ron and entered his home while Ron was at work. Dave found illegal gambling cards in the home and several names of clients. Dave later interviewed Ron’s clients, who confirmed the book maker’s booking activities. Dave also met Bill, another of Ron’s clients, at a football game. Bill also stated Ron was the King Pin of illegal gambling in West Undershirt.

Before a grand jury, Dave testified to his investigation discoveries. An indictment was returned based solely on Dave’s testimony. Ron’s attorney filed a motion to dismiss the indictment based on his client’s 4th, 5th and 14th Amendment constitutional rights.

Should the court grant the motion based on constitutional violations?

a) Yes, because Dave violated Ron’s constitutional right to counsel.

b) Yes, because the search of the home was a warrant violation.

c) No, because dismissal of the indictment is not the appropriate remedy.

d) Yes, because the testimony would be deemed illegal.
