Answer Every Question on the MBE and Get As Many Points you Can to Pass the Bar Exam

Some questions on the MBE will stump you. You look at the call of the question, the fact pattern and the answer choices and you have eliminated at least half the answer question. But you are now stuck between two answers and you can’t decide which answer is the right one.

With the limited amount of time you have to answer every question, you are going to have to guess. At least with your decision down to two answers, you have a 50% chance of getting it right. Pick one of them and move on to the next question. Remember, you do not lose points for an incorrect answer.

Do not ever skip questions on the MBE. Answer them in the order they are given. Put a check by the question or even write down the number and, only, if you have time left, you can go back and recheck your answer.

But make sure you fill in the bubble for your answer choice for the correct question. You do not want to skip that question, lose your place on the bubble exam answer sheet and then mismark the remaining answers because you forgot you skipped the question. That is a horror story that has happened to applicants too many times to count.

The California Blues – Foreign Educated Students Fail the California Bar Exam at 80% for First Time Takers and 85% as Repeat Takers

The foreign educated/JD equivalent pass rate for first time takers was 19.8% and the repeat takers was 16%.

4 Weeks Until You Pass the Bar Exam

Today is 1 month to the February bar exam. Today is a good day to think about where you are in terms of your studying. By this time, you should be well into knowing and understanding the law. Of course, there will be areas where you are still weak, but, overall, do you know enough law to make it through the bar exam? If not, hit those review books and try to memorize the law as much as you are able to in the next 4 weeks.

The next 4 weeks are crucial to your run up to the bar exam. Once you have the law down, you need to practice – and practice alot. Go through your practice essays and your MBE questions like the bar exam is tomorrow.

Practicing your essays, MPTs and MBEs will ensure that you know the law and you know how to apply the law. Application of the law will be the difference between passing and failing.

Resist those voices of people who tell you horror stories, or want you to stop studying and power down. Accept that you have 30 days of study ahead of you. In the scheme of your lifetime, the next 30 days is not a lot of time to get yourself ready or to sacrifice to get yourself ready. It’s worth your time to have a lifetime career as a lawyer.

It’s all about getting yourself ready for the best performance of your life in February. Keep your focus.

Passing the MBE by Practicing MBE Questions

In order to do well on the MBE, you must know the fine distinctions of the law. You can study those fine distinctions by studying your outlines and then by working on questions.

It is not enough for you to work on the questions, review the answers and then move on. You must understand why you picked the right answer or the wrong answer. That is why you must read the explanation carefully, reading each answer choice explanation, whether right or wrong.

If you missed the question, ask yourself why you missed the question. Did you miss it because you didn’t know the law, didn’t know the facts or didn’t know the “trick” of the question? Sometimes with cursory reading of the fact pattern, you miss certain clues of law, certain facts that now seem important or even a confusion of what actually happened in the fact pattern. Sometimes you misapply the facts to the law.

Analyzing the question and the answer choices will help you understand if there is a pattern to your misses or if there are holes in your analysis.

2020 Changes to Florida Rules of Procedure that Will Help You with the Florida Bar Exam

There have been a few changes to Florida law that went into effect on January 1, 2020. 

First, there are changes to the courts' jurisdictional amounts. 

County court jurisdictional thresholds increased to $30,000 and to $50,000 on January 1, 2023.

Small claims cases will include cases up to $8,000.

Filers will be required to include a civil cover sheet specifying the dollar amount in dispute in cases exceeding $8,000 in value.

The new law maintains current rules that limits the provision of subsidized court mediation services to county court cases with an amount in controversy up to $15,000.

State law provides that appeals of county court orders or judgments with an amount in controversy greater than $15,000 will be heard by the district courts of appeal until January 1, 2023, when the provision repeals.

5 Weeks Until You Pass the Bar Exam

There are 5 weeks until the February 2020 bar exam.

Every day you must chip away at the large amount of material, taking manageable bites until you have mastered that bite and go onto the next one. As someone has once said, how do you eat an elephant – with one bite at a time. In other words, take smaller sections of the vast material, learn it and then take another section of the bar exam and learn that section, until, before you know it, you have learned the law, practiced your questions and are ready to sit for the bar exam.

Always stay in the moment of that day, because if you look too far ahead, you will waste precious time worrying about the large amount of material you must learn or how fast the time is ticking before the bar exam.

Taking the bar exam is not a sprint. You cannot do everything in one day. Do not drive yourself to exhaustion thinking that you must skip meals, skip the gym, skip sleeping in order to prepare yourself for the bar exam. You cannot run down your body or your mind. Take regular breaks so that you can come back refreshed and ready to learn.

Remember, it was the tortoise that won the race, and not the hare. And to quote the tortoise, “slowly does it every time”.

ABA Approves Thomas Jefferson Law School’s teach-out plan, giving TJLS ABA accreditation for 3 more years

A teach-out plan for Thomas Jefferson School of Law, allowing limited accreditation until the end of the spring 2023 term, has been approved by the council of the ABA’s Section of Legal Education and Admissions to the Bar.

After placing the San Diego law school on probation in November 2017, the council withdrew its ABA approval in last summer. An administrative panel affirmed that decision in November 2019.

Under the teach-out agreement, Thomas Jefferson’s ABA accreditation will cover current law students and transient students. If the law school loses its state license or fails to uphold obligations listed in the teach-out plan, the council retains its authority to remove ABA accreditation before the spring 2023 term ends.

The plan allows current students to complete their education at Thomas Jefferson’s campus in downtown San Diego.

The law school’s ultimate bar passage rate, which comprises 2016 graduates, is 63.83%. Its first-time pass rate for 2018 was 26.43%.

Amid its ABA accreditation problems, the school sought and received California accreditation in 2018, and it intends to operate as a state-accredited school after its ABA accreditation ends.

According to a statement the law school released in November, it would no longer admit students into its ABA-approved program. And starting in summer 2020, students would be enrolled into its state-accredited program.

Follow Your Schedule

By this time you should have set a realistic work schedule that allows for lecture time, review time, practice time and relaxation time.

Maintain your concentration level by varying your study activities, i.e. if you are reading an outline and losing focus, start practicing questions.

Know Your Law

You should be trying to commit to memory the black letter law.  

Knowing the law means that you internalize the material in such a way that you truly “own” it and can spit it out on demand.  This does not mean that you recognize the material or it seems familiar to you.  The bar exam requires you to know the rules with precision and specificity and to have a solid understanding of the rules.

Continue to do practice questions, essays and performance tests.

The 11th Circuit Dismissed a Lawsuit Accusing a Tech Company of Georgia’s Bar Exam Grading Errors

Law grads who were wrongly told that they failed the Georgia bar exam cannot recover damages against the software company they accused of producing the incorrect scores, the 11th Circuit has ruled last week. The per curiam opinion upheld dismissal of claims in a would-be class action for ordinary negligence, strict liability, negligent design and defamation.

The alleged glitch occurred during a rescoring process on the July 2015 and February 2016 bar exams.

Under Georgia’s scoring system, anyone who fails to get a 115 on the multistate exam automatically fails and the essays are not graded. Essays are scored for those with multistate scores above the cutoff. Those who are within five points of the passing grade of 270 get their essays regraded, and the higher essay score is used.

The plaintiffs alleged in their suit that, because of a software glitch, the regraded essays were not properly taken into consideration. They blamed the company, ILG Technologies, for the mishap.

The appeals court said the plaintiffs’ claims for defamation failed because they were unable to show that ILG Technologies published the bar exam results. ILG Technologies had transmitted the results to Georgia’s Office of Bar Admissions, which published the faulty information.

The plaintiffs’ other claims failed because of Georgia’s economic loss rule, which generally bars recovery by people suing over a contractual duty when they are not parties to the contract, the appeals court said.

Bar Professors UBE Bar Exam Review Course

Indiana, Illinois, Ohio, Kentucky, Michigan and the Case for the UBE; Indiana Looks to Join the UBE

Currently, 36 states use the UBE.  Indiana will be the latest state to join the UBE.  Here is what Indiana and its neighboring states of Illinois, Ohio, Kentucky and Michigan are doing for their bar exams.

Indiana

The Study Commission on the Future of the Indiana Bar Exam has completed its review of the state’s bar exam and is now recommending the Hoosier state join the UBE movement. Since Indiana already uses the Multistate Bar Exam and the Multistate Performance Test components of the UBE, completely transitioning would require the Indiana essay portion to be replaced with the Multistate Essay Exam.

Indiana’s overall pass rate for July 2019 was 65%

Illinois

Illinois switched to the UBE in July 2019, about three years after the Illinois State Bar Association endorsed a recommendation that the state adopt the national test.  Illinois passing score is 266.

Illinois’s overall pass rate for July 2019 was 71%

Ohio

Ohio plans to implement the UBE in July 2020. Ohio will only have to swap its 12 essay questions for the MEE in order to switch to the national exam since it is presently using the MBE and MPT.

Essays on the current Ohio exam count for a little more than 53% of the total score. However, the UBE would shift the weight so the MBE’s 200 multiple choice questions would comprise 50% of the score while the multistate essay exam would make up 30%. Ohio’s passing score will be 270.

Ohio’s overall pass rate for July 2019 was 73%

Kentucky

After a multiyear comprehensive review of its bar exam, the Kentucky Supreme Court followed the advice of the Kentucky Bar Admission Review Commission and rejected the adoption of the UBE in December 2016. But retired Kentucky Justice Bill Cunningham, who co-led the commission, expects the Bluegrass State will reverse course since the UBE failed by only one vote back then, and the composition of the state’s supreme court today seems to be more favorable toward the national test. 

Kentucky’s overall pass rate for July 2019 was 66%

Michigan

Michigan appears to have no plans to even consider adopting the UBE. Currently the state’s bar exam consists of 15 Michigan-specific essay questions and the MBE. 

Michigan’s overall pass rate for July 2019 was 61%.
