The July 2014 Bar Exam Results: Why Your MBE Scores Went Down

Many of the student inquiries to BarProfessors nationwide, who were 2x and 3x time bar takes, indicated to us that their MBE scores dropped an average of 5 to 8 points, and in some cases 12 to 15 points. To our knowledge, this has never happened in recent MBE times. So what was the cause and effect?

The MBE is going through several small reconstructions. There are longer fact patterns, single questions, fact based answers, less scale points, not revealing students’ raw scores, and, now, an additional tested subject, Federal Civil Procedure, which is a cross-over subject. These facts contributed to the lower MBE scores as well as the over-all lower bar pass rate nationwide. The Florida July 2014 bar pass rate was 71% - down from an average of 75%. Last week, Nevada’s results came out; the pass rate was 57% - down from an average of 65%.

This is the “new” MBE reality.

The July 2014 Bar Exam Results: Repeat Florida Bar Exam Takers: A Bar Professors’ Plan for Success

Florida repeat bar exam takers should be very concerned with their ability to pass the Florida Bar Exam for a second, third or multiple times.

As we have shown through our blog, the repeat bar exam taker numbers are substantially lower than first time takers. Absent a very structured study bar exam plan, many of the repeat bar exam takers will repeatedly fail the bar until they just give up on their dream of becoming a lawyer. As a law professor, I know too many students in this heart-breaking category. They are devastated with their failure beyond comprehension. They are literally paralyzed with indecision, depression and uncertainty about their career and, more importantly, they question their own ability to pass the bar.

The July 2014 Bar Exam Results: The MBE Push Back and the Lowered Scale Scores

I have talked with many students this bar exam cycle about their MBE scores. Many students I talked with failed the MBE while passing the state portion of their bar exam. The MBE is always difficult because you have to get the right answer or you get no points.

However, in this bar cycle the MBE results were devastating. The lower MBE scores across the board from every state has pushed down bar exam pass rates significantly in many states. For example, Florida’s pass rates are routinely 74%-75%. We’ve seen it as high as 77%. This bar cycle the Florida pass rate spiraled down to 71%.

Looking at the clues, the NCBE has obviously restructured and rescored the MBE. Although, the NCBE has given a very convoluted explanation as to why it no longer gives raw scores, the raw scores have been eliminated, so we can’t calculate the scaled scores. For a standard bar cycle in the past, scored scores have varied from 15-20 points. This bar cycle, the scaled scores seem to have been recalculated, and, possibly lowered. Without knowing the raw scores, we can only guess what the scaled scores were. In talking with students and evaluating their scores, it seems certain that the scores across the country have been lowered by about 5 points.

The hardest hit group is the repeat bar exam taker. They have been the ones who desperately needed an extra 5 points in order to pass the MBE.

In addition to the recalculation of the scaled scores, we will see Federal Civil Procedure on February 2015’s bar cycle, making the February 2015 MBE a nightmare for repeat takers.

For repeat takers taking the February 2015 bar exam you should start preparing now. You must retain a Florida bar exam tutor. Trying and preparing the same way has produced negative results. The July 2014 Bar Exam Results: The MBE or Essays, When You Fail the Florida Bar Exam

What happens if you only pass one section of the bar but fail the overall bar? Should you sit for that section that you failed or do you take the entire bar exam over again? I think it depends on which section you passed. I will use Florida as my test case. In this possible scenario, say you pass the Florida section but fail the MBE. Should you take the Florida section again to get carry-over points for your MBE score?

I think it depends on what your MBE score is. I usually tell my students that you have to stay competitive in the MBE and let your extra points on the Florida section pull you over the top. It is my experience that many of the students who pass the bar, do not pass the MBE or only have a 1-5 point pass on the MBE. That is why I think doing well on the Florida essays for those extra overage points can help you pass the overall bar, even if you do not pass the MBE.

First, evaluate your scores. Unfortunately, the NCBE has decided, not to give you a raw score or to list how you did in each subject. This is of a great disadvantage to the repeat taker, since the repeat taker does not know if he has a weak or strong testing subject. But we do know, that in the past, the scaled score was anywhere between 12-18 points. So, you can approximate how you did, percentage wise, on the MBE. The closer you are to the magic 65%, the better you are to make improvements in the MBE for an outright 136 or above.

Evaluate your essay scores. Did you pass the essays with a large margin? If you did, it’s an easier decision to make – you obviously write well and 3 more essays won’t freak you out. I think that if you sharpen up your writing with some more practice essays, you could get maybe another 5-10 points to bring over to your MBE scores. If you passed with only points to spare, you may not be able to pass another 3 more essays.

That’s the pros and cons of your situation. You must make the decision for yourself. Of course, it is easier to concentrate on only one section of the bar and if you think you can pull up your score on one section alone, then go for that one section alone. But you want to make sure that your second attempt is your last attempt. So do anything and everything to make that happen.
Don’t do anything rash or rush your decision making.

I also believe that once you fail the bar that you would better spend your money on a private tutor, if a repeater is to spend any more money in the process. It is expensive, but working one on one with a qualified (and I mean qualified) tutor will push you over the finish line. To me, no price is too much to get you to your goal and start your life as a lawyer. A private tutor can help with the subject material, motivate you and keep up your confidence. The July 2014 Bar Exam Results: Repeat Florida Bar Exam Takers: What Does Your Score Really Mean

As you know, taking the Florida bar exam will be a challenging experience for all repeat bar exam takers. However, you must review and understand the breakdown of your scores. There are some important indicators as it relates to your July 2014 bar exam scores.
Let’s first start with the MBE. If you made below a scaled 125, that’s a clear indication that you lack the requisite knowledge of the subject matter, that you do not understand the methodology of the MBE and that you are not reading critically to obtain the proper factual analysis. You will not be able to score any higher on the MBE on your next bar exam if you do not get help. In light of this, you should retain a Bar Professors Florida bar tutor. Next, is the Florida essays. Students score low on the Florida essays because they do not read and analyze each essay using the line by line approach. The July 2014 Florida Bar Exam Results: Retaining a Florida Bar Exam Tutor for Repeat Takers

We have been talking with students every day since the bar exam results came out. The questions we’ve been asked more frequently is “what should I do if I was unsuccessful on the Florida Bar Exam?” First, let the shock of failing the bar subside with a few days of reflection. Clearly, this may be one of your greatest disappointments, but don’t let it control or define who you are. You can pass the bar exam in February 2015. Get right back up and say, “I will pass in February 2015.
