The February 2016 Bar Exam: Include Your Family in Studying for the Bar Exam

For those students who are taking the February 2016 bar exam, take a few days off to relax your mind and have quality time with those that love you. Take the time off with no guilt attached. You can get back to work full time after the holidays.

Those that really love you want to see you pass the bar. Know that with certainty. Those who are pulling and picking at you, saying you don’t have to study that long or want you to go to the clubs and parties are not your true friends and do not want you to be successful.

Sometimes those loved ones see you study and see your struggle and wish they could help you, but don’t know how. Bar applicants who have children find it hard to be both a parent and have a full time study plan. Don’t ignore them. Try to integrate them into your “experience”.

During these weeks of celebration for Hanukkah, Christmas and New Years’, look at those that are supporting you in ways you may not even realize. Maybe your mom makes you breakfast every morning before you leave to go study. Maybe your spouse is doing the heavy lifting as you study. Let them know you appreciate their support, even if they are just getting out of your way during this period before the bar exam.

No person is an island. You need your family and friends during this stressful period of bar exam studying. Have your family help you. They will be glad to help and they will be proud of the little part they played in your success. Give your family members or your children one of your study books and have them test you. This is particularly good for the elements of a cause of action. Have your family help you recite those causes of action. See if you can make a game out of it, with your children or family members each calling out an element of a cause of action.

You may be surprised on game day when you are calling up the exceptions to the hearsay rule and you remember the face of your loved ones yelling it out to you.

Have a terrific holiday. Rest, relax and then get back to work. The February Bar Exam is right around the corner.

The February 2016 Bar Exam: Keep a Limited Study Schedule Through the Holidays

Christmas is on Friday, our families are making plans for the holidays, we are doing our last minute shopping and making sure we have our travel plans in place for visiting. Yet, you have the February 2016 bar exam right around the corner.

This is not the time to do round-the-clock studying. You will not be able to keep up a schedule like that anyway and you shouldn’t have to do it during this time of the year. But there are batches of time you can take during these holidays so that you can keep up your schedule plan.

Don’t put the books away. If you are traveling by plane or by train, you certainly can read your outlines instead of playing games or watching movies on your computer or phone. If you are driving to your destination, get some tapes and play them as you drive instead of listening to music to pass the time. You can get an hour or two in for studying every day while you are enjoying the holidays. Think about getting up an hour early while everyone else is still asleep or go to bed an hour early and read your outlines in bed before you sleep.

Also think about taking a few days off completely from studying , i.e Christmas Day, New Year’s Eve– it will refresh your mind and make you eager to get back to work after those breaks.

These study techniques will keep you focused on the job ahead, but also allow you to take the remaining time off and relax with your family. You know that your family will do anything to help you achieve your goal, so let them fuss over you – you deserve it.

The February 2016 Bar Exam: Understand the Black Letter Law

You must build a good, solid foundation of the black letter law. In order to have a good foundation, you must review each bar exam subject. Go through each subject, one by one and absorb each subject as best you can. As you go through the subject, make sure you understand the basic law before you move on.

To build a foundation of the law, you need to break the subject areas into more manageable components. Break your subject into topics. And go through the elements of the topics of each subject.

What I mean by that is to take a subject, like Torts. Then break the Tort subject down to topics, i.e. Negligence. Do you know all the elements of negligence? Do you know the elements of battery? You can outline it and/or make sure you know it by heart before you move on. You can do that memorization by reciting it or writing it down without looking at your notes or outlines.

Once you feel you know that topic, do a few essay questions and some MBE on that topic just so you know you have it.

The February 2016 Bar Exam: Sound Like a Lawyer When You Write

The purpose of the bar exam is for the bar examiners to determine if you are ready to be a lawyer. That’s why using lawyer-like words will help you when you write.

I don’t mean for you to use legalisms or a lot of “wherefor art thou” type of language. Instead use the verbs that lawyers use. For example, don’t tell the bar examiners that the court will find the criminal defendant innocent. A defendant is always found not guilty. When a plaintiff prevails, don’t say that the plaintiff won the case. Instead of telling the bar examiners that the court will reject the petition, tell the bar examiners that the court will dismiss the petition. Instead of a party losing a venue issue, for example, say that the party waived his right to it.

Also use “term of art” lawyer words. For example, one of my pet peeves is when a law students doesn’t use the word pretermitted child when discussing a child who was omitted from a will . Use words like elective share when discussing what the spouse is entitled to in the will.

Your essay will be much better when you use language that lawyers use.

Remember, write like a lawyer for your bar exam essays and MPTs. Only then will the bar examiners know you are ready to practice law.

The February 2016 Bar Exam: Learn Your Bar Exam

Bar Exams are creatures of habits. If you study your bar exam you should have a pretty good idea of what you will see when you sit for your bar exam in February 2016.

Look at past exams in your state. What is the format? Is it a long fact pattern or a short fact pattern? Look at the call of the question. What type is the call of question? Is it a generic type, i.e , talk about the issues that give you no clue as to the essay itself or is it a two or three specific questions that you can answer, pointing the way to the issues that the bar examiners want you to focus on?

Now, look at the subjects tested on your past exams. Is there a pattern of frequently tested subjects? Are there 7 or 8 topics that the bar examiners like more than others? This will enable you to practice those frequently tested subjects.

By learning your bar exam, you will be better prepared to face the unknown and you will not be surprised when you open your exam booklet on the day of the bar exam.

The February 2016 Bar Exam: The Last New York Bar Exam

February 2016 will be the last New York bar exam ever given. Effective July 2016, New York will administer the Uniform Bar Exam (UBE).

The New York section consists of five essay questions and 50 multiple choice questions prepared by the New York Board, and one Multistate Performance Test question, developed by the National Conference of Bar Examiners. Students take the MBE on the following day.

The UBE consists of the MBE Exam, two MPTs, and six 30 minute essays.

The February 2016 Bar Exam: Answering Only the Call of the Question

Often in essay answers, I have seen students try to impress the bar examiners with all of their knowledge, even if it doesn’t apply to the specific call of the question.

The bar examiners don’t want a bunch of archane and esoteric information that you know about a particular subject. Don’t tell the bar examiners that the question is particularly interesting or that you know a lot of the subject at hand. Don’t make jokes in your essay answer.

Time is of the essence. The bar examiners craft the questions for the time allocated. They do not expect to see anything unrelated to the specific s of the question.

I have seen essay answers that look panic-stricken with a lot of useless information at the end of the answer, as if the student is putting everything in the answer but the kitchen sink. These brain dumps do nothing for you and will get you no extra points.

As boring as it sounds, answer the specific call of the question only.

Essay writing is a skill that you must master in order to pass the bar exam. For those persons who have failed the bar exam and are repeat takers, you have to examine how you have answered your essays and look for ways to improve your performance.

Many bar examiners write the bar exam as if the essays are a first interview with a new client. Keep that in mind as you write for an uninformed audience. Assume your audience knows nothing about the law. For example, if the client says someone hit him, you want to explain to that client why it is a battery and why the facts indicate it is a battery. You set out the law and then you analyze the facts as it pertains to the law. A knowledge of the substantive law is essential, as well as how you communicate your analysis to your client.

A key to good communication is your organization. If you are poorly organized, the bar examiner will find it hard to follow your essay or to give you much needed points.

Make sure you practice writing essays. Essays will become easier to write as you practice.

Also, remember that you must finish your essay in the time allotted by your exam. You cannot get points if you do not complete your essay.

Goal achievement is the key to studying for the bar exam, especially if you are a repeat taker. You must keep your eye on your ultimate goal – passing the bar exam, along with figuring out how best to get to that ultimate goal of passing the bar exam.
How do you go about getting prepared for the bar exam? Let’s look at your study goals. You need to accomplish two things: the ultimate and overall goal, which is to pass the bar exam, and a day-to-day goal, which is to work towards achieving your ultimate goal.

It is not only about setting your goals for success, but also by developing the strategies to achieve the goal and then implementing the strategies.

Implementing the strategies of passing the bar exam include goals, each and every day that you must work on. We have discussed employing a study plan. That study plan should include a goal each day – i.e. working on the black letter law or working on improving your essays, MBEs or MPTs. Make sure the goal is a realistic goal, but make sure that you are moving forward each and every day. Implementing your strategy includes working on your weaknesses every day so that you can improve your performance when it comes time to sit for your bar exam.

Remember that studying for the bar exam is a journey that must be accomplished in incremental steps.

The philosopher, Confucius, once said that “success depends upon previous preparation, and without such preparation, there is sure to be failure.”

Muhammad Ali, the champion boxer, said that “I hated every minute of the training, but I said, “Don’t quit. Suffer now and live the rest of your life as a champion.”

February 2016 will be your championship moment, don’t let yourself down.

In order to pass the bar exam in February 2016, you need two things: time-management and discipline. Planning ahead and sticking to a schedule will conquer both requirements. Thorough preparation is the key to passing the exam and having a schedule in place will allow you to manage your time and to stick to a study timetable. For a plan to work, you have to address your learning style as well as the substantive areas you will be tested on.

First make a calendar of the next 3 months – up to the bar exam date in February 2015. Set out a timetable of when and where you will study per day. Be sure your schedule is realistic. If you make it too onerous, you will not follow the schedule and you will put off studying. Be realistic with your goals and your study habits. For example, you can’t go throughout the entire day with no lunch or no exercise or take no breaks because you were unrealistic in the time aspect of your plan. You have to write a study plan that suits you and your personality without slacking off.

In the beginning, you are going to struggle with the voluminous materials, but keep at it and keep pushing the pace. It’s like training for a race. You first have to struggle through the repetition until it starts feeling right and you start performing at your optimal level.

For your schedule, you should first start with relearning and reviewing the outlines with some practice questions thrown in and as you pick up the pace, you’ll reverse it and do more practice questions and essays and only use your outlines for clarification on questions you get wrong or confused about.

Don’t ignore your weak areas or your strong areas. You may not need to schedule as much time in your stronger subjects, but review them as consistently as you do all the other subjects. You may not need to read or reread the outlines of your strong subjects, but during those time periods, practice your questions. You may need those extra points on the bar. For your weaker subjects, don’t spend too much time obsessing on your lack of knowledge or take away from other subjects you also need to study; and do not ignore your weak subjects. All bar examinees have weak subjects. Again, spend time on those subjects as you would other subjects and just keep practicing. You’ll be surprised at how much you really do know in those weak subjects.

All states have released its results for the July 2015 bar exam. Congratulations to those who have passed this bar cycle – you have much to be thankful for at the start of your new career as a lawyer.

For those who have not passed yet, don’t be discouraged. You must look to February 2016 to get ready to take the bar exam again.
You must pass the bar exam and get it behind you.

December 1st is a good place to take the time to think about how to pass the bar exam and the mechanics of how you should study and prepare. The Bar Exam Results for July 2015: Black Friday: Bombing the Bar Exam

With California coming out last week, and as we have reported in previous blogs, the bar exam pass rates have plummeted across the country.

In California, passage rates for the exam in July hit the lowest point since 1986, with just 46.6% of total applicants and 60% of first-time test takers passing.

In New York, the passage rate for first-time test takers dropped 4 percentage points since the July 2014 test, from 74% to 70%, hitting the lowest point since 2004.

Passage rates also dropped in Washington, DC, Florida, Georgia, New Jersey, and Pennsylvania.

The average score on the MBE on the July bar exam fell 1.6 points from the previous year, reaching its lowest level since 1988, according to data provided by the National Conference of Bar Examiners. The mean score on the July bar exam was 139.9, down from 141.5 in July 2014.

Many students go into the bar exam not understanding the magnitude of the exam and the proper methodology needed to pass. Further, the additional MBE subject has trended lower MBE scores nationwide.

Nevertheless, there is one inescapable conclusion – you must pass the bar exam. The Bar Exam Results for July 2015: Repeat Takers Statistics For California

California’s bar exam results have been released. Overall, the first time taker rate was 60% , but the repeat pass rate was a very low 16%. 30% of bar applicants were repeat takers.

No matter which category your school fell under, the repeat pass rate was appalling. For California ABA schools, the repeat rate was: 24%; For Out of State ABA schools, the repeat rate was 16%, For CA Accredited, not ABA, the repeat rate was 8%. For Unaccredited, fixed facility schools the repeat rate: 0%; for Unaccredited, correspondence schools the repeat rate was 5%, for Unaccredited distance learning schools, the repeat rate was 11%

The LLM pass rates have yet to be reported, but judging from how our foreign educated attorneys fail in New York and by looking at the current statistics coming out of California, the pass rate was abysmal.

The July 2015 Bar Exam: The Lower MBE Scores and the New Reality

The MBE scores have been systematically lower since the NCBE has made its changes.

If you have read Bar Professors tweets and blogs, you know that the average score on the MBE on the July bar exam fell 1.6 points from the previous year, reaching its lowest level since 1988, according to data provided by the National Conference of Bar Examiners. The mean score on the July bar exam was 139.9, down from 141.5 in July 2014.

In speaking with students, they feel the test is harder because this is the first July when Civil Procedure has been tested in “mass” numbers. The NCBE, however, disputes this assessment, saying that the students did poorly across the board in all 7 subjects.

We do know that performance on the bar exam has continued to dip down to levels we have never seen and it appears that this is not an aberration, but a new realty.

Look at your own state scores. Most states have also dipped below their July 2014 numbers, mainly because of the MBE. The repeat takers fare even worse. That 1.5 point variance is the difference between pass and fail for some repeat takers.

The February 2016 Bar Exam: Say Good Bye to The Last New York Bar Exam

February 2016 will be the last New York bar exam ever given. Effective July 2016, New York will administer the Uniform Bar Exam (UBE).

The New York section consists of five essay questions and 50 multiple choice questions prepared by the New York Board, and one Multistate Performance Test question, developed by the National Conference of Bar Examiners. Students take the MBE on the following day.

The UBE consists of the MBE Exam, two MPTs, and six 30 minute essays.

Our students fall into two categories: Those who hate the UBE and those who want to wait for the UBE.

We have students who dread the idea of even taking the UBE and are determined to pass in February. These students are all from New York, went to New York law schools and know New York law. If they don’t pass, they must forget everything they learned about New York law and learn the MEE essay topics. They will have to get new bar exam books and have to get used to writing 30 minute general essays instead of 45 minute New York essays. They then have to take 2 MPTs instead of the standard 1 MPT they are used to taking.

To those students – take the step to get a Bar Professors tutor so that you will pass in February and not have to face the nightmare of having to alter your studies and take a whole new bar exam that you are not familiar with.

We have students asking us whether they should sit out the February bar exam because they think the UBE may be easier to pass. These students are usually the LLM or foreign educated students or the students who are unfamiliar with New York law. In addition, if they get a high enough score (a 266), regardless of where they took the UBE, they can waive into New York. The LLM students and the foreign educated attorneys have had a difficult time in passing the New York bar exam – less than 45% pass the bar exam at any given time – and the repeat rate is down to the 30s.

We caution those students who think it will be easier to pass the UBE and will sit out for February. Getting a 266 on the UBE is a tough proposition. We have helped students in other jurisdictions pass the UBE. It is no cake walk. LLM students find it almost an impossible task to complete 2 MPTs in the time given. The Bar Exam Results for July 2015: Passing the California or New York Bar Exam When English is Your Second Language

The bar exam results for July 2015 from New York indicated that foreign educated lawyers passed at a first time rate of 42%, and that all foreign educated lawyers passed at a 33% rate. A drop from previous years. In California, the statistics of foreign educated lawyers are equally bad.

We have been receiving e-mails from applicants who are having trouble with the bar exam because English is their second language. Also, we have had a multitude of people from foreign cities read this blog.

How should a person prepare for the New York or California bar exam when English is their second language?

The Bar Exam Results for July 2015: Repeat Bar Exam Takers: A Plan for Success

Repeat bar exam takers should be very concerned with their ability to pass the bar exam for a second, third or multiple times.

As we have shown throughout our blog, the repeat bar exam taker numbers are substantially lower than first time takers. Absent a very structured study bar exam plan, many of the repeat bar exam takers will repeatedly fail the bar until they just give up on their dream of becoming a lawyer. As a law professor, I know too many students in this heart-breaking category. They are devastated with their failure beyond comprehension. They are literally paralyzed with indecision, depression and uncertainty about their career and, more importantly, they question their own ability to pass the bar.

My advice is to start with a very intensive structured plan. Obtain a Bar Professors' tutor and, more importantly, believe you will pass. Above all else, do not prepare for the exam as you did the first time. You have to change your approach with a structured plan for success. Good luck.

The Bar Exam Results for July 2015: New York’s Grim Reality for Repeat Takers

In honor of Halloween, here is about the most scary statistic I have seen for repeat takers in New York.

For repeat takers in New York, the pass rate is dismal. For all students who took the New York bar exam as repeat takers, the pass rate for February 2015 was 35%, for July 2015, it was 22% and combined it was 29%. Put another way, 4,632 repeat takers sat for the combined 2015 bar exams and only 1,349 students passed. A very gloomy statistic.

For NY ABA Law Schools: in February 2015, the repeat taker pass rate was 45%, in July 2015, it was 31% and combined was 39%.

For Out of State ABA Law Schools, the pass rate for repeat takers in February was 43%, in July 2015 it was 23% and for the combined year, it was 35%.

For All ABA Law Schools, the pass rate for repeat takers in February was 44%, in July 2015 it was 27% and for the combined year, it was 37%.

For Foreign Educated students, the pass rate for repeat takers in February was 24%, in July 2013 it was 17% and for the combined year, it was 20%.

Interestingly, the statistics seem to favor the repeat bar taker in February, rather than July. Most repeat bar exam takers have the misimpression that February is a harder bar exam.

The Bar Exam Results for July 2015: The Low Scores on The New York Bar Exam

Bar Professors has done a quick comparison of the scores from July 2015 and July 2014 for New York. The scores dropped considerably – much like many other states.

The overall pass rate from July 2014 to July 2015 dropped by 4% points. July 2014’s overall pass rate was 65% and July 2015’s overall pass rate was 61%.

The overall first time taker pass rate for July 2014 was 74%. In July 2015, the overall first time taker pass rate was only 70% - a drop of 4%.

Without the foreign educated attorneys, the first time taker rate was 83% in July 2014, but only 79% in July 2015.

The foreign educated pass rates stayed statistically the same. In July 2014, the pass rate was 44% for first time takers and the overall pass rate was 34%. In July 2015, the foreign educated attorneys pass rate was 42% for first time takers and 33% overall.

As we know, February 2016 will be the last New York exam – the UBE will take its place in July 2016.

The Bar Exam Results for July 2015: The New York Bar Exam Statistics

The New York bar exam results for July 2015 are now out, as well as the statistics. New York had a 61% overall pass rate. For first time takers it is 70%, which includes foreign educated attorneys. Without the foreign educated attorneys, the first time taker pass rate is 79%.

The foreign educated attorneys pass rate is 42% for first time takers and 33% overall.

New York will post its public lookup on Wednesday.

Interestingly, the Board examined 10,671 candidates, which is the lowest number of candidates to sit for a July bar examination since 2006. The number of graduates from American Bar Association accredited law schools who took the bar examination for the first time in July 2015 was 6,535, which is the lowest number since the July 2004 examination.

The Bar Exam Results for July 2015: The MBE Push Back

The MBE has pushed back again this year.

If you have read Bar Professors tweets and blogs, you know that the average score on the MBE on the July bar exam fell 1.6 points from the previous year, reaching its lowest level since 1988, according to data provided by the National Conference of Bar Examiners. The mean score on the July bar exam was 139.9, down from 141.5 in July 2014.

Of course, the NCBE doesn’t blame the test but the law students. The pile-on has begun with deans and law professors all blaming the students that they created. Fearing for their own jobs, the deans and law professors are saying that they’ve been admitting students with lower qualifications who then fail the bar exam. It seems like it’s a problem the law schools have created, however, it’s this author’s opinion that the teaching at law schools is the real culprit.

In speaking with students, they feel the test is harder because this is the first July when Civil Procedure has been tested in “mass” numbers. The NCBE, however, disputes this assessment, saying that the students did poorly across the board in all 7 subjects.

Whatever created this problem, we do know that performance on the bar exam has continued to dip down to levels we have never seen and it appears that this is not an aberration, but a new realty.

Here are the changes in overall bar pass rate, from July 2014 over July 2015, for some of the states already reported.

Florida, -2 points (July 2014 – 71%; July 2015: 68.9%)
Kansas, -3 points (July 2014: 79%; July 2015: 76%)
Mississippi, -27 points (July 2014: 78%; July 2015: 51%)
Missouri, -1 point (July 2014: 85%; July 2015: 84%)
Montana, -2 points (July 2014: 64%; July 2015: 62%)
New Mexico, -12 points (July 2014: 84%; July 2015: 72%)
North Carolina, -4 points (July 2014: 71%; July 2015: 67%)
Oklahoma, -11 points (July 2014: 79%; July 2015: 68%)
Washington, -1 point (July 2014: 77%; July 2015: 76%)
West Virginia, -5 points (July 2014: 74%; July 2015: 69%)
Wisconsin, -10 points (July 2014: 75%; July 2015: 65%)


So far, one of the few states that have gone up, Iowa, is now switching to the UBE starting in February. A mere coincidence? Perhaps not.
