The February 2015 Bar Exam: Federal Civil Procedure Question Analysis

Candy was driving north on Hill Road in Atlantic City when her car collided with Bryan’s car, driving west on State Lane. Both Candy and Bryan suffered serious personal injuries, and both cars were damaged. Candy wants to sue Bryan in federal court in Atlantic City. To meet the requirements of the Federal Rules of Civil Procedure, Candy’s complaint

A. Must be a short and plain statement of the claim showing that Candy is entitled to relief.
B. Must state facts sufficient to form a cause of action.
C. Must state a claim in ordinary and concise language without repetition.
D. Must plead facts but not evidence.
