The MBE scores have been systematically lower since the NCBE has made its changes.

The mean scaled score on the February administration of the MBE fell to 135, down 1.2 points from the previous year and the lowest average score on a February administration of the test since 1983. That is a 33 year low for the MBE.

The July 2015 results were also down 1.6 points from the previous year, to 139.9, its lowest point since 1988.

The NCBE believes the downward trend is likely to continue for at least a couple more years. We do know that performance on the bar exam has continued to dip down to levels we have never seen and it appears that this is not an aberration, but a new realty.

It’s now mid-August and that means that the North Carolina bar exam may be coming out in approximately 2 weeks from now. The end of August is usually when the North Carolina bar exam results come out.

Bar Professors will be offering for the February 2017 North Carolina bar exam, a tutorial program covering North Carolina essays and the MBE.

Also, Bar Professors will be conducting a North Carolina seminar in Raleigh and Charlotte, North Carolina in October 2016. For the essay portion of the seminar, we will teach you specific techniques that will impact greatly on your essays, such as line by line analysis, timing, understanding the status of the parties, the importance of the call of the question and factual analysis. The Changes in MBE and MEE Property for February 2017

Effective with the February 2017 administration, there will be changes to the Real Property scope of coverage for the MBE and the MEE.
New topics will include conflicts of law, property owners’ associations and common interest ownership communities, drafting, review, and negotiation of closing documents, and persons authorized to execute real estate documents.

Minor modifications will include providing specific examples of rules affecting future interests, including security deposits in termination of tenancies, providing more detailed zoning topics, and including as separate topics transfers of restrictive covenants, transfers of easements, profits, and licenses, and acceleration of loans before foreclosure.

Real Property topics will no longer include application of Article 9 of the Uniform Commercial Code to fixtures or abatement of devises.

The July 2016 Bar Exam: The New UBE states for the February 2017 Bar Exam and Beyond

The states are falling for the UBE every bar exam cycle. New York and Washington, DC were the latest states to go to the UBE.

Now, for the February 2017 exam, New Jersey, Connecticut and South Carolina are all going to administer the UBE. All 3 states (and including New York and DC) passing score is 266.

West Virginia will administer the UBE for the first time in July 2017 and Massachusetts will administer the UBE for the first time in July 2018.

The July 2016 Bar Exam: Should Law Schools Be Responsible for Students Pass Rates?

The ABA is considering a plan that would force all law schools to ensure that 75% of their students pass the bar exam within two years of graduation.

The US Department of Education is pressuring the ABA to hold law schools accountable for its students’ pass rate. As we know, many law students leave law school with enormous debt they are unable to pay because the student cannot pass the bar exam.

The current ABA rule allows law schools to meet the bar passage requirement in two ways: At least 75% of their graduates pass the bar exam during 3 or more of the past 5 years or the first-time bar pass rate is no more than 15% below the statewide average in at least 3 of the past 5 years. This would jeopardize the accreditation of many schools
