Most law graduates are under the false impression that the more times you take a state bar exam the greater your changes are to passing
In fact, it is just the opposite. The more times you sit for a state bar, you decrease your chances of being successful.

The statistical proof is clear and convincing that repeat takers continuously do poorer on the bar exam than first time takers. Here are the hard facts:

The Pennsylvania February 2016 bar results indicate that the first time takers passed at 75%. The second time takers pass rate was 54%, the third time taker pass rate was 32% and the fourth time takers passed at 19%.

In Massachusetts, for the February 2016 bar results, first time takers passed at a 61% rate, second time takers passed at a 54%, third time takers passed at a 38% rate, fifth time taker or more at a 5%.

I am always amazed that students who fail the bar exam tell us that they are just going to retake their commercial bar exam course again. Obviously, it did not help you pass the first time, why would you think that it will help you pass the next time or the third time or the fourth time?

Repeat Takers Statistics for the California Bar Exam

California’s bar exam results have been released. Statistical analyses show that of the 4,758 applicants who took the GBX, 29.3 percent were first-time takers. The passing rate for the 1,395 first-time applicants was 45.0 percent overall. The passing rate for the 3,363 applicants repeating the examination was 32.0 percent overall. The lowest since February 2009.

No matter which category your school fell under, the repeat pass rate was appalling. For California ABA schools, the repeat rate was: 46%; For Out of State ABA schools, the repeat rate was 32%, For CA Accredited, not ABA, the repeat rate was 16%. For Unaccredited, fixed facility schools the repeat rate: 10%; for Unaccredited, correspondence schools the repeat rate was 11%, for Unaccredited distance learning schools, the repeat rate was 7%

The LLM pass rates have yet to be reported, but judging from how our foreign educated attorneys fail in New York and by looking at the current statistics coming out of California, the pass rate was abysmal.

MBE scores have fallen again to new lows. The mean scaled score on the February administration of the MBE fell to 135, down 1.2 points from the previous year and the lowest average score on a February administration of the test since 1983. That is a 33 year low for the MBE.

The July 2015 results were also down 1.6 points from the previous year, to 139.9, its lowest point since 1988.

The NCBE believes the downward trend is likely to continue for at least a couple more years. As we can see from the bar exam scores coming from each state, the law pass rate has been devastating across the country. Low scores are seemingly the norm now – the new reality.

The pass rate for the states that use the UBE have been astonishingly low. We have seen most UBE states in the 60 - 65% and lower range. The bar exam results for February 2016 indicated that foreign educated lawyers passed at a first time rate of 34% and that all foreign educated lawyers passed at a 30% rate.
