Some States Consider Lowering Pass Scores on the Bar Exam

Several states are considering lowering pass scores on bar exam, making it easier to pass for students and, perhaps, addressing racial diversity problems and access-to-justice issues that have been entrenched in the legal profession.

First it was California who lowered its passing score on the bar exam. Now, Rhode Island has followed California’s lead in lowering the bar exam pass score to make the test easier to pass, a step that several other states are also considering.

The Rhode Island Supreme Court lowered the score needed to pass the bar exam from 276 to 270 and made the change retroactive to the February 2021 exam, following the recommendation of the state’s board of bar examiners.

Many states are considering a lower cut score in hopes that will increase access to justice and lawyer diversity.

The passing scores are not uniform, even in the 38 states that use the UBE. The passing scores in these states range from 260 to 280. The passing score is determined by state courts and bar exam authorities.

Pennsylvania Will Go to the UBE Bar Exam in July 2022

Beginning with the July 2022 bar exam, Pennsylvania will administer the Uniform Bar Exam provided by the National Conference of Bar Examiners. After careful consideration, the Board recommended and the Supreme Court approved Pennsylvania’s adoption of the UBE. There were a number of reasons for this decision, one of which is the increasing importance to applicants of having “portable” scores.

Pennsylvania will provide additional information on the Board’s website, including the passing score.

Many jurisdictions now offer the UBE.  Currently only 11 states do not offer the UBE. Hawaii, Virginia, Florida, Wisconsin, Louisiana, Georgia, Mississippi, Michigan, South Dakota and California do not offer the UBE, although some of these states do have some MEE essays.

California, Washington, DC, New York, Ohio, Pennsylvania, Illinois, New Jersey and Other States Are Announcing Plans to Administer Remote Testing for the July 2021 Bar Exam

As jurisdictions continue to monitor the COVID-19 situation, some states have already announced that they would continue to have remote testing for the July 2021 bar exam.  17 states have now announced that they would administer the full test remotely, like the February 2021 bar exam.

These states include California, Colorado, Connecticut, Washington, DC, Illinois, Iowa, Kentucky, Maryland, Massachusetts, New York, New Hampshire, New Jersey, Ohio, Pennsylvania, Tennessee, Vermont, and Washington. 

As the July bar exam nears, other states will announce whether they will administer a remote exam or an in person bar exam. 

Moreover, for the state of Washington, the state Supreme Court authorized not only a remote test for July 2021 but also temporarily lowered the minimum passing score to 266.

New York Announces That They Will Administer a Remote Online Bar Exam for July 2021 and Limit Applicants to 10,000

Although vaccinations are now available and the number of COVID-19 cases is decreasing, the COVID-19 pandemic has not abated sufficiently to permit the Board of Law Examiners to safely conduct in-person testing of large numbers of bar applicants in New York. Therefore, in order to provide sufficient notice to prospective bar exam applicants, the July 2021 New York Bar Examination will be administered remotely.

 On February 2, 2021, the National Conference of Bar Examiners (NCBE) announced that it will make a full set of Uniform Bar Exam materials available for a remote examination in July 2021.

Application to the July 27-28, 2021 bar examination will be open to all eligible applicants. However, the Board will cap the number of applications at 10,000. The application filing period for the July 27-28, 2021 New York bar examination is April 1 – 30, 2021. The application will close on April 30, 2021 or when the 10,000 cap is reached. Applicants shall apply through their BOLE Account in the Applicant Services Portal.

Since the results from the February 2021 bar examination are not anticipated to be released until late April, applicants who are unsuccessful on the February 2021 New York bar examination will be provided an opportunity to apply for the July 2021 bar examination after the release of the February 2021 New York bar exam results.
