On Friday, the Florida bar exam results came out and, as we know, the pass rate for first time takers was 72%. These statistics only reflect first time takers. The overall pass rate was in the vicinity of 47%, which means the repeat taker pass rate was shockingly much lower.  Only about 30% of the Florida bar exam takers were repeat takers. 

There were 3137 applicants who remotely sat for the bar exam, down from the usual numbers of over 5000. That means that many applicants decided not to sit for the bar exam, especially repeat bar exam takers. It is clear that there will be a lot more applicants for the February remote exam.

Also, remember that the MBE will again be tested in February after it was not tested in the October remote exam.

California's February Bar Exam Will Be Held Online

California’s Supreme Court on Thursday announced that the February bar exam will be held online under similar conditions as those governing the October test, saying the COVID-19 pandemic continues to make an in-person examination difficult.

The two-day exam, set for Feb. 23 and 24 will be the second test offered with the new passing score of 1390.

The Supreme Court said the exam will still be administered in-person at the discretion of the California State Bar to applicants "granted testing accommodations that cannot be effectively provided and securely administered in a remote environment." Individuals with other extenuating circumstances can also take the test in-person, the Supreme Court added.

Also in October, the state Supreme Court and bar announced the launch of a commission to study the future of California's bar exam, in particular looking at whether alternative or additional testing should be implemented.

The Joint Supreme Court/State Bar Blue Ribbon Commission on the Future of the California Bar Exam will mull changes to the exam "and whether to adopt alternative or additional testing or tools to ensure minimum competence to practice law," according to the commission's charter. Notably, the group considered whether the bar exam should be administered online or in person, in the wake of the October exam.

The state Supreme Court recently greenlighted a program that will allow law school graduates to practice law even if they haven't taken the bar exam or passed the February bar exam, the latest measure intended to support recent graduates whose plans have been disrupted during the COVID-19 pandemic.

The Florida Bar Exam Results for October 2020 will come out on tomorrow, November 20th. There is no magical time it comes out, although the results in past bar cycles usually come out around 9:30 – 10 am. As we know, the tested subjects on the Florida bar exam was only Part A – the Florida portion.  The MBE was not tested in October.

Many applicants did not sit for the October remote exam. We will have to wait to see how the Florida Board of Bar Examiners tested this bar cycle.  But if you decided to wait until February to sit for the Florida bar exam or if you end up not passing the exam tomorrow, Bar Professors is here to help you for February 2021.

New York Opens Another Round of Registration for the February 2021 Bar Exam, This Time for the Foreign Educated Applicants

In New York, registration for the February 2021 bar exam has been proceeding on a rolling basis. The first application filing period, which included first-time Juris Doctor candidates who graduated from an ABA-approved law school in 2020 and repeater Juris Doctor candidates who graduated from an ABA-approved law school between 2016 and 2020, took place from November 1 to 15, 2020, and is now closed.

The second application filing period will open to a limited number of foreign-educated applicants on a “first-come, first-served basis” starting at 10:00 AM on November 17, 2020. The Board will announce when all available seats have been taken during the Second Application Filing Period, which shall, in any event, close no later than 11:59 PM on November 30, 2020. Interested applicants are highly encouraged to apply as soon as the Second Application Period opens on November 17, 2020 by logging into their account through the Applicant Services Portal.

Eligibility requirements for the second application filing period include first-time foreign-educated candidates whose foreign legal education has already been approved by the Board and who (1) graduated with an LL.M. degree from an ABA-approved law school in the United States in 2020 or will graduate with such degree in 2020, January 2021 or February 2021, and (2) did not take any bar examination (in person or remotely) in any U.S. state, district or territory during 2020 or first-time foreign-educated candidates who received advanced approval by the Board to sit for the New York bar examination and who (1) received their foreign legal education from a common-law jurisdiction, and (2) graduated with their first degree in law from this common law jurisdiction in 2020, and (3) did not take any bar examination (in person or remotely) in any U.S. state, district or territory during 2020.

Western Michigan University Votes to End its Affiliation from Cooley Law School

Western Michigan University’s board of trustees voted Thursday to end its affiliation with the Cooley Law School. Western Michigan University will separate from Cooley Law School after hopes for the partnership failed to materialize over the last seven years.

The WMU Board of Trustees voted unanimously to begin a three-year process to withdraw from agreements that first created Western Michigan University Thomas M. Cooley Law School in July 2013. Under the agreement the schools had co-branding, but maintained financial and academic autonomy.

The affiliation agreement requires a written notice of three years if one party decides to terminate the agreement. The agreement stated that the institutions had hoped that the affiliation would improve the quality of education at both schools, but that did not happen.

Western Michigan University believed that affiliation with Cooley had become a distraction from the university’s core mission. In the past three (3) years, the law school has faced two public notices of accreditation compliance issues.

In May, the council of the ABA’s Section of Legal Education and Admissions to the Bar found that Cooley Law was one of 10 schools not in compliance with Standard 316, a recently revised accreditation standard that requires a bar passage rate of at least 75% within two years. The school’s ultimate bar passage, which is based on 2017 graduates, is 66.01%, according to ABA data.

The law school also received public notice from the council in 2017 that it was out of compliance with Standard 501(b), which focuses on admissions, and Interpretation 501-1, which discusses factors to consider in admissions.

The separation comes after Cooley announced another effort to downsize the law school, once the largest in the country, by merging its Grand Rapids campus with the location in Lansing.

Cooley once had campuses in Lansing, Ann Arbor, Grand Rapids, Auburn Hills and Riverview, Florida, near Tampa. At its peak in 2010, it enrolled nearly 4,000 students.

There were 1,156 students enrolled at Cooley in the fall of 2019, according to its website. Once the Grand Rapids campus closes next year, only the Lansing and Florida campuses will remain.

Reducing the size of the law school has allowed Cooley officials to focus on enrolling students who can better pass the state bar exam, reduce tuition, continue operations without a significant deficit and shed unneeded infrastructure.

Texas Released its Statistics and Pass Rate For Its September Bar Exam. For Repeat Takers, Enroll in Bar Professors’ New Texas UBE Program for February 2021

Texas has released its September bar exam statistics and pass rate. The overall pass rate was 76.7% with first time takers passing at 85% with the repeat taker pass rate at 42%. The repeat taker pass rate for only Texas law schools was only 39%.

For repeat takers from TSU, the pass rate was only 21%, from St. Mary’s the repeat taker rate was 33%, from the U of North Texas, the repeat pass rate was 40%, from STCL Houston, it was 47%.  It is obvious that repeat takers need help.

Although Texas did have an October bar exam, also, those applicants who failed the bar exam on Friday will have to take the UBE exam in February.
