The statistical proof is clear and convincing that repeat takers continuously do poorer on the bar exam than first time takers. Here are the hard facts:

In California, the February 2017 repeat taker pass rate was only 33%.

The Pennsylvania February 2017 bar results indicate that the first time takers passed at 72%. The second time takers pass rate was 53%, the third time taker pass rate was 32%.

With the release of Arizona’s bar exam results, all of the UBE states have come out.  The pass rate for the states that use the UBE have been astonishingly low.  We have seen most UBE states in the 60 – 65% and lower range.  Arizona’s overall pass rate was 41%,.  Last year the overall pass rate was 49%, an 8% decrease from last year.  This pass rate for the February 2017 bar exam was the worst Arizona has seen for more than 11 years.

For the July 2016 bar exam,  the repeat pass rate in California was a very low 17%.  33% of bar applicants were repeat takers.

No matter which category your school fell under, the repeat pass rate was appalling.  For California ABA schools, the repeat rate was:  23%; For Out of State ABA schools, the repeat rate was 20%, For CA Accredited, not ABA, the repeat rate was 9%.  For Unaccredited, fixed facility schools the  repeat rate: 5%; for Unaccredited, correspondence schools the  repeat rate was 7%, for Unaccredited distance learning schools, the repeat rate was 9%

The February 2017 Bar Exam: The New California Bar Exam for July 2017

California’s bar exam is undergoing a change starting in July 2017.  Instead of three days, the California’s bar exam will be 2 days – on Tuesday and Wednesday, bringing it in line with other states.

On Tuesday, the “state” portion of the bar exam will consist of 3 1-hour long essays in the morning session.  The afternoon session will consist of 2 more 1-hour long essays with a 90-minute performance test (instead of the usual  3 hour CPT).

On Wednesday, as usual, the MBE will be tested.

During the grading, the written and MBE portions of the examination will be weighted equally at 50% each, The minimum scaled score of 1440 will remain the same as that which is currently required to pass the California Bar Examination.

The scope of subjects tested on the California Bar Examination will also remain unchanged.
