The July 2016 Bar Exam: The Horror Story of Repeat Takers in North Carolina and their 72% Failure Rate

The pass rate for North Carolina for repeat takers was a dismal 27.7%.
Wake Forest’s repeat taker pass rate was 29%; UNC’s their repeat taker pass rate was 57%, Campbell’s their repeat taker pass rate was 54%, NCCU’s repeat taker rate was 31% , Elon’s repeat taker pass rate was 8%, Charlotte’s repeat taker pass rate was 31%.
It is clear from the data that repeat bar takers fail at a rate of 72% every time they take the bar exam. All repeat takers need help passing the North Carolina bar exam. The July 2016 Bar Exam: Repeat UBE Bar Exam Takers and The UBE Crying Game

As we close in on October, a number of UBE states show continued pass-rate declines, especially for the repeat taker.
Approximately 23 states have released July bar exam results, 18 of the states are UBE/MEE states. Among them, Washington, Missouri, North Dakota, Oregon and Iowa each saw a decline in their overall pass rates. Iowa’s pass rate dropped 15 percent—the largest reported decline thus far.
The repeat bar exam pass rate was even worse. Alabama’s repeat taker pass rate was 24.8%. In Iowa, the repeat taker pass rate was 29% and 0 for 3rd time takers. In Missouri, the repeat bar exam taker pass rate was 41% for 2nd time takers, and a 36% pass rate for 3+ takers. . Oregon’s repeat taker pass rate was 43%.
These weak results for the UBE and its repeat takers do not bode well for the jurisdictions that haven’t yet released scores, like Washington, DC or New York.
Nevertheless, there is one inescapable conclusion – you must pass the bar exam. Similar to last year, 6 out of the 11 Florida law schools was below the state average of 68.2% and 4 law schools scored below 60%. Moreover, the difference between the highest bar percentage of 87.5% by FIU and St. Thomas, the lowest scoring school, at 45.5% was 42 points.
We have interviewed many people on this issue, from legal schools, bar experts, law professors and even law students. Their conclusions are that, the Florida bar exam is becoming less predictable in light of the new tested subjects. Many students go into the bar exam not understanding the magnitude of the exam and the proper methodology needed to pass. Further, the additional MBE subject has trended lower MBE scores nationwide. Of course, the law students at the lower tier schools are blaming their poor performance on their law schools’ doorstep, while the deans and law professors are blaming the law students for not preparing sufficiently.

The July 2016 Bar Exam: Repeat Florida Bar Exam Takers: A Review of Your Bar Exam Scores

The Florida bar exam results have come out and all the repeat takers have gotten their letter telling them the breakdown of the scores. Here is the way the grading is done in Florida.
Grading the Florida Bar Exam
The MBE & Florida sections are weighted equally on the Florida Bar Exam. A combined weighted score of 136 is required to pass the Florida Bar Exam. It doesn’t matter if your score in one section or the other is below the 136 – it’s the average score that matters. So basically you can fail the FL or the MBE section and still pass the FL bar exam if your overall score is at least 136.
Each examination paper produced by an applicant on the General Bar Examination will be separately graded. The sum of the converted section scores is the total score for Part A. MBE scores (Part B) are the scaled scores on the MBE provided by the National Conference of Bar Examiners. On the Florida portion of the bar, each essay is worth 100 points for a 300 point total. The multiple choice questions are worth 100 points total, so each question is approximately 1 point each. There are usually 10 experimental questions. The average essay score is around 40 points, requiring you to get your remaining points on the multiple choice questions.
Depending on the difficulty of the essay question and the average grade, the Board of Bar Examiners may adjust your score either downward or upward. The Board does not adjust the multiple choice questions – there are what they are and the point totals do not change.

We have been talking with students all week. The July 2016 Bar Exam: The Long Weekend Wait for the Florida Bar Exam Results

The Florida Bar Exam Results for July 2016 will come out on Monday, September 19th. There is no magical time it comes out, although the results usually come out in the morning, usually before 10 am.
Florida releases the numbers, not the names of the applicants and the site reveals just pass or fail of both Part A (the Florida section) and Part B (the MBE section) and the overall pass or fail. When you look up your number there will be 4 columns: your number, pass, pass, pass. The last pass is your ticket for your law license. You can fail a section of the Florida bar, and with enough carry over points, you can pass overall. So you will see some scores, like fail, pass, pass or pass, fail, pass. That’s ok, because that applicant has passed the Florida bar exam. Look at the final column and you’ll know whether you passed or failed.
The Florida Board of Bar Examiners also releases the passing rate of the law schools a bit later. The Florida Board of Bar Examiners releases the passing rate of the law school to the law school first. Florida only releases the first time taker rate and not the repeat takers rate, and not the overall pass rate.

The July 2016 Bar Exam: The MBE Scores Are Still Extremely Low and the Repeat Bar Exam Takers Are in Trouble

The national mean score on the MBE for July 2016 is 140.3 – statistically the same from last year. The July 2015 results were down 1.6 points from the previous year, to 139.9, its lowest point since 1988. The mean scaled score on the February administration of the MBE fell to 135, down 1.2 points from the previous year and the lowest average score on a February administration of the test since 1983. That is a 33 year low for the MBE.
The NCBE believes the downward trend is likely to continue.
We have seen much lower MBE scores since the implementation of civil procedure to the MBE. In addition, the NCBE has increased its experimental questions from 10 to 25, which makes each question of higher value. And finally, the NCBE is making changes to the property questions effective this February. We will see the effects of these changes for the February 2017 bar exam.
These changes and low scores mean disaster to the repeat taker. As we know, repeat takers score consistently lower on the MBE than first time takers. The July 2016 Bar Exam: The Horror Story of Repeat Takers in North Carolina and their 72% Failure Rate

The pass rate for North Carolina for first time takers was 66% and the pass rate for repeat takers was a dismal 27.7%.
For the individual schools:
Duke’s first time taker pass rate was 95% and their repeat taker pass rate was 100%,
Wake Forest’s first time taker pass rate was 81% and their repeat taker pass rate was 29% ,
UNC’s first time taker pass rate was 78% and their repeat taker pass rate was 57%,
Campbell’s first time taker pass rate was 70% and their repeat taker pass rate was 54%,
NCCU’s first time taker pass rate was 63% and their repeat taker rate was 31% ,
Elon’s first time pass rate was 54% and their repeat taker pass rate was 8%,
Charlotte’s first time taker pass rate was 45% and their repeat taker pass rate was 31%.
It is clear from the data that repeat bar takers fail at a rate of 72% every time they take the bar exam. Take out Duke's 100% and its even worse than we think. All repeat takers need help passing the North Carolina bar exam. The July 2016 Bar Exam: Georgia and the Nightmare of Incorrect Scores

As we wait for the release of bar exam results, all of us have had nightmares about how we did or how the exam was scored. The usual nightmare of monsters in the closet seemed to have come true for some test takers in Georgia and other states.
On Tuesday, the Georgia Board of Bar Examiners announced that 45 takers on both the July 2015 exam and the February 2016 exam incorrectly had been told they failed when they actually passed, according to law.com.
It’s not the first time that scoring errors have occurred, per law.com. A handful of jurisdictions have incorrectly told exam takers that they either passed or failed over the past two decades.
In 2014, the Nebraska State Bar Commission mistakenly told three people they passed when they failed, and three people who failed were informed that they passed. One affected test taker, who was told he actually failed just less than a day before he was to be sworn into the bar.
In 2007, the South Carolina Supreme Court adopted a scoring change that allowed 20 test takers who had initially failed to later pass because of a scoring error on the section of the test on wills, trusts and estates.
A 2003 scoring error on the February MBE changed nearly 7,700 scores out of the 20,000 test takers,although it changed few overall outcomes.
In 1999, the New Jersey Board of Bar Examiners incorrectly recorded scores and 13 takers were told they passed when they actually failed. Three people who failed actually passed. Two years earlier, the board lost 117 answer booklets during the grading process.
It’s unknown how many bar exam scoring mistakes are never caught or publicly disclosed.

We have been talking with students this week about the North Carolina bar exam. More specifically, the students cannot believe that they end up with 0s and 1s on their bar exam essays. Every student we’ve talked to claims that they knew the issues, but still ended up with no points or even a lousy 1 point.
Remember that North Carolina has a 10 point grading system and a 5 or 6 is considered an average score. So, as we see, there is no room for error. If you end up with even one essay with an 0 or 1, you are probably not going to pass the North Carolina bar exam. You must score average or above.
