Release dates for some states are coming closer to reality. The July 2016 bar exam results release dates by states for the first week in September.
North Carolina: We are looking at late this week for the sending of the results letters. Students look to be getting their letters either Monday or Tuesday. After North Carolina, Oklahoma will be coming out on that Thursday – September 1st. Wisconsin has set their release date for Friday, September 2nd, although some set it as Wednesday, August 31st. Wyoming and Kansas are early release dates, too – last year, the release date was Sept. 5th. Also in the mix is West Virginia, Oregon and Arkansas who usually come out the first week of September.

As we can see, the Florida bar exam is changing. In the last 3 bar cycles we have gotten issues that normally only appear in the multiple choice sections. A few bar cycles ago we had a little wills thrown in, we have gotten criminal law and criminal procedure and federal constitutional law seems to be the hot topic.

The July 2016 Bar Exam: Is the Bar Exam More Difficult?

If you have read Bar Professors tweets and blogs, you know that the average score on the MBE on the July bar exam fell 1.6 points from the previous year, reaching its lowest level since 1988, according to data provided by the National Conference of Bar Examiners. The mean score on the July bar exam was 139.9, down from 141.5 in July 2014. The mean scaled score on the February administration of the MBE fell to 135, down 1.2 points from the previous year and the lowest average score on a February administration of the test since 1983. That is a 33 year low for the MBE.

The MBE scores have been systematically lower since the NCBE has made its changes.

This has resulted in state scores that have been consistently lower than in past years. Florida, Kansas, Mississippi, New Mexico, North Carolina, Oklahoma, Wisconsin, West Virginia, to only name a few states, saw lower pass rates in their July or February results.

This overall decline may be the new reality or may be a future trend.

The July 2016 Bar Exam: MBE Scores and the New Reality

The MBE scores have been systematically lower since the NCBE has made its changes.

The mean scaled score on the February administration of the MBE fell to 135, down 1.2 points from the previous year and the lowest average score on a February administration of the test since 1983. That is a 33 year low for the MBE.

The July 2015 results were also down 1.6 points from the previous year, to 139.9, its lowest point since 1988.

The NCBE believes the downward trend is likely to continue for at least a couple more years. We do know that performance on the bar exam has continued to dip down to levels we have never seen and it appears that this is not an aberration, but a new realty.

The Changes in MBE and MEE Property for February 2017

Effective with the February 2017 administration, there will be changes to the Real Property scope of coverage for the MBE and the MEE.
New topics will include conflicts of law, property owners’ associations and common interest ownership communities, drafting, review, and negotiation of closing documents, and persons authorized to execute real estate documents.

Minor modifications will include providing specific examples of rules affecting future interests, including security deposits in termination of tenancies, providing more detailed zoning topics, and including as separate topics transfers of restrictive covenants, transfers of easements, profits, and licenses, and acceleration of loans before foreclosure.

Real Property topics will no longer include application of Article 9 of the Uniform Commercial Code to fixtures or abatement of devises.

The July 2016 Bar Exam: The New UBE states for the February 2017 Bar Exam and Beyond

The states are falling for the UBE every bar exam cycle. New York and Washington, DC were the latest states to go to the UBE.

Now, for the February 2017 exam, New Jersey, Connecticut and South Carolina are all going to administer the UBE. All 3 states (and including New York and DC) passing score is 266.

West Virginia will administer the UBE for the first time in July 2017 and Massachusetts will administer the UBE for the first time in July 2018.

The July 2016 Bar Exam: Should Law Schools Be Responsible for Students Pass Rates?

The ABA is considering a plan that would force all law schools to ensure that 75% of their students pass the bar exam within two years of graduation.

The US Department of Education is pressuring the ABA to hold law schools accountable for its students’ pass rate. As we know, many law students leave law school with enormous debt they are unable to pay because the student cannot pass the bar exam.

The current ABA rule allows law schools to meet the bar passage requirement in two ways: At least 75% of their graduates pass the bar exam during 3 or more of the past 5 years or the first-time bar pass rate is no more than 15% below the statewide average in at least 3 of the past 5 years. This would jeopardize the accreditation of many schools
