This week, with California holding the last spot, all states have released its results for the July 2013 bar exam. Congratulations to those who have passed this bar cycle – you have much to be thankful for at the start of your new career as a lawyer.

July 2013 Bar Results: The California Bar Exam Results Statistics

The State Bar of California's Committee of Bar Examiners reported that 55.8% of the applicants passed the July 2013 General Bar Examination (GBX).
Preliminary statistical analyses show that of the 8,900 applicants who took the exam, 74.6% were first-time takers. The passing rate for the 6,636 first-time applicants was 68% overall. The passing rate for the 2,264 applicants repeating the examination was 21% overall.
Preliminary statistical analyses show the first-time and repeater percent passing the exam by law school type as follows:
California ABA: first time taker pass rate: 76%; repeat taker pass rate: 33%
Out of state ABA: first time taker pass rate: 64%; repeat taker pass rate: 19%
CA accredited (but not ABA): first time taker pass rate: 36%; repeat taker pass rate: 13%
Unaccredited fixed faculty: first time taker pass rate: 14%; repeat taker pass rate: 11%
Unaccredited Correspondence: first time taker pass rate: 35%; repeat taker pass rate: 12%
Unaccredited Distance Learning: first time taker pass rate: 16%; repeat taker pass rate: 7%
It is very telling statistic that if you are going to take the California bar exam, it is better to go to an ABA school in California. There is an 12% difference between CA ABA schools vs. non-CA ABA schools. In most states, there is not much difference between pass rates of state schools vs. non state law schools.
It is also interesting to note that it’s better to attend an unaccredited correspondence school than any other non-ABA school in California – even the CA accredited, but not ABA schools. Obviously the non-ABA schools in California are a waste of time and money, even with their buildings and faculty, at least for those students trying to pass the bar exam.

July 2013 Bar Results: Foreign Educated Lawyers: When You Must Pass the New York and California Bar Exams

The bar exam results for July 2013 from New York indicated that foreign educated lawyers passed at a first time rate of 46%, and that all foreign educated lawyers passed at a 37% rate. In California, the results are even worse. In July 2012, California’s foreign educated lawyers passed at an 16.5% first time rate, with repeat takers passing at only a 9.6%.

The February 2014 Bar Exam: Plan Ahead and Stick to A Schedule

In order to pass the bar exam in February 2014, you need two things: time-management and discipline. Planning ahead and sticking to a schedule will conquer both requirements. Thorough preparation is the key to passing the exam and having a schedule in place will allow you to manage your time and to stick to a study timetable. For a plan to work, you have to address your learning style as well as the substantive areas you will be tested on.
First make a calendar of the next 3 months – up to the bar exam date in February 2014. Set out a timetable of when and where you will study per day. Be sure your schedule is realistic. If you make it too onerous, you will not follow the schedule and you will put off studying. Be realistic with your goals and your study habits. For example, you can’t go throughout the entire day with no lunch or no exercise or take no breaks because you were unrealistic in the time aspect of your plan. You have to write a study plan that suits you and your personality without slacking off.
In the beginning, you are going to struggle with the voluminous materials, but keep at it and keep pushing the pace. It’s like training for a race. You first have to struggle through the repetition until it starts feeling right and you start performing at your optimal level.
For your schedule, you should first start with relearning and reviewing the outlines with some practice questions thrown in and as you pick up the pace, you’ll reverse it and do more practice questions and essays and only use your outlines for clarification on questions you get wrong or confused about.
Don’t ignore your weak areas or your strong areas. You may not need to schedule as much time in your stronger subjects, but review them as consistently as you do all the other subjects. You may not need to read or reread the outlines of your strong subjects, but during those time periods, practice your questions. You may need those extra points on the bar. For your weaker subjects, don’t spend too much time obsessing on your lack of knowledge or take away from other subjects you also need to study; and do not ignore your weak subjects. All bar examinees have weak subjects. Again, spend time on those subjects as you would other subjects and just keep practicing. You’ll be surprised at how much you really do know in those weak subjects.

The July 2013 Bar Exam: Character and Fitness to Practice Law

After passing the bar exam, all applicants must go through character and fitness evaluations before they are admitted to the bar exam. Here is an interesting case coming out of California.
Stephen Glass applied to practice law in California after passing the state's bar exam in 2007. But State Bar officials have been grappling with his application since, finally appealing to the California Supreme Court to decide.
Glass says he made up all or parts of 42 magazine articles published in the New Republic, Rolling Stone and elsewhere in the 1990s when he was in his mid-20s and a rising literary star. He then tried to cover up his deceit by creating business cards, a fictitious Web site and having his brother pose as a source when editors began scrutinizing his work.
Two years after he was drummed out of journalism in 1998, Glass graduated from Georgetown University's law school. He first passed the New York bar exam, but was disqualified from practicing law. Chief Justice Tani Cantil-Sakauye noted that Glass gave misleading information to New York State Bar officials by undercounting the number of articles he fabricated when applying for a law license in that state. New York officials rejected his application to practice law in that state in 2004.
At the hearing, several California Supreme Court justices expressed skepticism Wednesday that a disgraced former journalist who fabricated dozens of articles for well-known publications is morally fit to practice law. A majority of the court appeared to agree that Glass has not done enough good works since his fall from grace 15 years ago to be allowed to practice law in California.
Justice Ming Chin said it appeared Glass benefited from his fraud by publishing a novel in 2003 loosely based on his life that earned him $140,000. Justice Chin also noted that Glass has never paid back the money he earned by publishing the fabricated articles.
Justice Corrigan said she was troubled with Glass' lack of an extensive record of volunteerism and willingness to act as a cautionary tale for aspiring journalists through speaking engagements at colleges and elsewhere.
The California Supreme Court has 90 days to decide whether to give Mr. Glass a law license. Currently, he is a paralegal working in LA.

The July 2013 Bar Exam: Why Do Law Students Fail the Bar Exam

Now that most of the bar exam results have been posted, those who have failed their bar exam must analyze their scores and figure out why they failed and how to pass their bar exam for February 2014. Today we will discuss why you failed and, in a later blog, discuss ways to pass the bar exam.
You reverted back to bad writing habits developed in law school.
Under the pressures of the bar exam, many students revert back to bad habits. These bad habits allowed you to graduate from law school, even with average grades, but you cannot continue to write the way you did in law school. Some of your bad habits include, not organizing your answer, no line by line analysis and not answering the call of the question.
You have Poor Preparation and Time Management.
You may have started bar preparation entirely too late, leaving yourself in a rush mode. For the upcoming February 2014 bar, your preparation should start no later than November, 2013. You should allow yourself 5 to 6 hours per day for studying. But more importantly, studying correctly is the key. You need to write and answer many essays and MBE questions. Your answers must be evaluated by a private tutor.
You don’t really believe that you will pass
You may have been that student in law school that got an average to below average grades. Or you struggled through law school. However, in the back of your mind, you know that you were not a good student and you know that the bar exam is hard. You must have a belief that you will pass. The July 2013 Bar Exam: Passing the New York Bar Exam When English is Your Second Language

The bar exam results for July 2013 from New York indicated that foreign educated lawyers passed at a first time rate of 46%, and that all foreign educated lawyers passed at a 37% rate.

New York repeat bar exam takers should be very concerned with their ability to pass the New York Bar Exam for a second, third or multiple times.
As we have shown through our blog, the repeat bar exam taker numbers are substantially lower than first time takers. Hard work and having a study plan and study strategy will pay off. Say to yourself, “I will be a lawyer.”
You want to get the bar exam behind you and start your new life as a lawyer. Don’t dither or waste time with the “what ifs”. Stay focused and true to your goal to pass.
