The July 2013 Bar Exam: The Florida Bar Exam’s New Tested Subjects

In prior blogs, we discussed the new tested subjects on the Florida bar exam effective February 2013. For the February 2013 bar exam, I had my students in Florida review the new subjects on the bar exam. We went over secured transactions, commercial paper, dependency and juvenile delinquency. Yet, none of those subjects were tested on the bar exam (although dependency may have been a small issue in the family law essay. We must continue to prepare for these subjects when facing the July 2013 bar exam.

The main concern for the students I talked to was Article 3 and Article 9 of the UCC. Unfortunately, many students did not take the two subjects during law school and must learn it for the first time.. Additionally, the repeat bar taker did not learn the subject through their bar review course and are now facing the prospect that they will have to learn the two subjects, along with prepping to take the Florida bar exam again. The July 2013 Bar Exam: Second Career and Older Students Facing the Bar Exam

We have seen many older students who have decided to go back to law school as a second career. Sometimes it seems like their fellow students, who are younger than they are, seem to pick up the material faster, despite the younger students’ often careless attitudes towards studying.

The older student finishes law school, but despite studying hard, has trouble picking up the tactics and strategies to pass the bar exam.

Statistics show that older students and students coming from a second career score lower on the bar exam than the average law student. There are many theories for this disparity, but it’s not that the older student doesn’t know the material. The difference is how the older student applies the material in a lawyer-like fashion when he/she has spent time at another career. As we know, legal writing is much different than writing for a newspaper or writing a report for your previous job.

The February 2013 Bar Exam Results: The UBE/MEE Exam Analysis

The Uniform Bar Examination (UBE) consists of six 30-minute questions and 2 Multiple Performance Tests (MPT). States that have the UBE are Alabama, Arizona, Colorado, Idaho, Minnesota, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Utah, Washington and Wyoming. The MEE omits the 2 MPT tests, but has nine 30-minute questions. The Multistate Essay Examination (MEE) is given in 28 jurisdictions including Arkansas, Connecticut, Washington, D.C., Illinois, Iowa, Kentucky, Mississippi, New Mexico, Oregon, Rhode Island, South Dakota, West Virginia, and Wisconsin.

For the February 2013 bar exam, the 6 MEE essays included property, contracts, constitutional law, agency and partnership, evidence and negotiable instruments.

For scoring, each essay and each MPT answer was worth 12 points, raw score. The average raw score per essay was:

Essay 1 - Property: 3.86 = 32%
Essay 2 - Contracts: 5.20 = 43%
Essay 3 – Const. Law: 6.27 = 52%
Essay 4 – Agency/Partnership: 6.65 = 55%
Essay 5 - Evidence: 4.98 = 42%
Essay 6 – Neg. Instr,: 4.05 = 34%
MPT 1 - Martel: 5.27 = 44%
MPT 2 - Fox: 6.21 = 52%

Looking at the essays, it is clear that Property and Negotiable Instruments were the hardest essays. The easiest, Agency/Partnership and Constitutional Law.

For the MPT, the Fox assignment was clearly the easier of the two MPTs.

With California releasing their results last Friday, most of the states, except for Georgia, have released their bar exam results. For those takers who have failed the bar exam, you will need a bar exam tutor to get you over the finish line.

The February 2013 Bar Exam Results: California’s Preliminary Statistics

The preliminary stats from California indicated that 4,419 applicants took the California bar exam for February 2013. Only 31% were first time takers. That means that a whopping 69% of the people sitting for the February bar exam were repeat takers! There were 1,371 first time takers compared to 3,048 repeat takers. That is quite a number.

The first time taker pass rate was 52%. The repeat taker pass rate was 36%.

Here are the statistics for the type of schools for the California bar exam:

California ABA: First time takers: 60%; Repeaters: 50%
Out of State ABA: First time takers: 49%; Repeaters: 39%
California Accredited (but not ABA): First time takers: 25%; Repeaters: 17%
Unaccredited Fixed Faculty: First time takers: 14%; Repeaters: 12%
Unaccredited Correspondence: First time takers: 42%; Repeaters: 16%
Unaccredited Distance learning: First time takers: 29%; Repeaters: 9%

It is very telling statistic that if you are going to take the California bar exam, it is better to go to an ABA school in California. There is an 11% difference between CA ABA schools vs. non-CA ABA schools. In most states, there is not much difference between pass rates of state schools vs. non state law schools.

It is also interesting to note that it’s better to attend an unaccredited correspondence school than any other non-ABA school in California –even the CA accredited, but not ABA schools. Obviously the non-ABA schools in California are a waste of time and money, even with their buildings and faculty, at least to those students trying to pass the bar exam.

The February 2013 Bar Exam Results: California Has Released Its Results

The California Bar Exam Results has released its results for private look-up. On Sunday, May 19th, California will release the results for public look-up.

Preliminary statistical analyses show that of the 4,419 applicants who took the GBX, 31 percent were first-time takers. The passing rate for 1,371 first-time applicants was 52 percent overall. The passing rate for the 3,048 applicants repeating the examination was 36 percent overall.

The February 2013 Bar Exam Results: The MBE

We have seen how the MBE has “shaken” out for the February 2013 bar exam.

The average raw score for the MBE subjects is:
Evidence: 19.03 out of 33
Const. Law: 19.17 out of 33
Property: 19.63 out of 33
Contracts: 20.06 out of 34
Criminal Law/Pro: 20.07 out of 33
Torts: 21.25 out of 34

I have put the average raw score in order of hardest to easiest. As we can see this February, 2013, the hardest subjects were evidence and constitutional law; the easiest subjects were criminal law/procedure and torts. It is a surprise to see constitutional law as one of the harder subjects. In addition, from what my students told me, property did not have many future interests or mortgage questions, which was a great relief to many and pushed property into the middle range of the subjects (when it usually the hardest subject).

The average range for all the subjects is from 58% to 62.5%. These are the numbers you should be reaching when you practice your MBE questions.

It appears that the scaled score this year fits within the usual range of 12-15 extra points, depending on where you fall for the raw score. That is consistent with prior years.

The February 2013 Bar Exam Results: Michigan, Rhode Island, New Jersey, Nevada, California

For this week, it looks like we will see the bar exam results for February 2013 from Michigan, Rhode Island, New Jersey, Nevada and California coming out.

We know that Nevada’s bar exam results come out on Thursday, the 16th, and California’s bar exam results are coming out on Friday, the 17th. New Jersey’s bar exam results will also be released on Friday, the 17th. Rhode Island’s bar exam results will also be released on Friday, the 17th.

We still don’t know the date that Michigan will be released. But judging by the anxiety I am seeing from the students taking Michigan, hopefully, it will be released early this week.

Arizona has released its bar exam results for February 2013. There were 344 applicants, of whom 228 met the score requirement for admission in Arizona. The overall pass rate was 66.3 percent. The names of those who passed are listed on its website.

The February 2013 Bar Exam Results: Colorado’s Bar Exam Results Have Been Released

Colorado has released its bar exam results for February 2013. Colorado had a 69% pass rate for all takers, including both attorney and students. For first time takers, the pass rate was 77%, the repeat taker rate was 49%.

The statistics for the law schools are:

University of Colorado: First time taker pass rate: 67%, Repeat taker pass rate: 50%

Denver: First time taker pass rate: 78%, Repeat taker pass rate: 54%

National: First time taker pass rate: 100 %

Other: First time taker pass rate: 75%, Repeat taker pass rate: 36%

The Nationals are: Columbia, Harvard, Stanford, Yale; Duke, Michigan, Chicago, California Berkeley, Virginia, Texas

The Failure Rate of the California Baby Bar

The next round of testing for the California baby bar is now only 7 weeks away. The test will be given on June 25, 2013.
As you know, it is crucial that you pass the California First Year Law Students’ Examination as soon as possible and within the allotted three times or you will have to retake your law school classes.

The statistics for the California First Year Law Students’ Examination are very telling. Let’s look at the categories and the overall statistics of the October Exam.

For those students from unaccredited correspondence schools: the percentage of passing is 21%
Distance learning schools: the percentage of passing is 13.8%
Unaccredited fixed faculty: the percentage of passing is 15.4%
CA schools approved by the ABA: the percentage of passing is 15.6%
CA accredited but not approved by the ABA: the percentage of passing is 9.4%

Total percentage of passing is 15.7% The First Time Taker Pass Rate is 21.9%, while the repeat taker rate is 11.6%

As you can see, the percentage rate of failure is an astounding 84% with only 16% passing. You read that right – the statistics are pretty incredible and it personally makes me wonder why the schools are not working with the students and making all efforts to help the students pass the exam. Yes, we can go back and forth about the quality of the students, but I do put the blame squarely on the schools that take tuition from students and allow scores like this for their student body. A student who wants to be a lawyer should have every opportunity of success.

The February 2013 Bar Exam Results: The New Tested Subjects for the Florida Bar Exam

In prior blogs, we discussed the new tested subjects on the Florida bar exam effective February 2013. For the February 2013 bar exam, I had my students in Florida review the new subjects on the bar exam. We went over secured transactions, commercial paper, dependency and juvenile delinquency. Yet, none of those subjects were tested on the bar exam (although dependency may have been a small issue in the family law essay). Why not? The Florida Bar Examiners made a big production of changing the rules and letting everyone know that the changes would be effective for the February 2013 bar exam. I remember getting the drafts of the new changes, 4 or 5 years ago. Are they waiting for the “larger” bar exam crowd in July to launch the new subjects or will that be a bust, too? Will the new subject essays be a stand alone or will it be part of a cross over subject?

The main concern for the students I talked to was Article 3 and Article 9 of the UCC. Unfortunately, many students did not take the two subjects during law school and must learn it anew. Additionally, the repeat bar taker did not learn the subject through their bar review course and are now facing the prospect that they will have to learn the two subjects, along with prepping to take the Florida bar exam again.

We will discuss the subjects in more depth at a later date, but if you can’t answer these questions, then you will have to take time to learn the subject matter.

For Article 3 ask yourself: What is a negotiable instrument? What are the types of negotiable instruments? What are the requirements of the instrument? What are the demands for payment and to whom?

For Article 9, What is the scope of Article 9? How do you create a secured interest? What is an attachment? How do you perfect the attachment? Who gets priority?

Repeat Bar Exam Takers: The Myths and Reality of Passing

Most law graduates are under the false impression that the more times you take a state bar exam the greater your changes are to passing

In fact, it is just the opposite. The more times you sit for a state bar, you decrease your chances of being successful.

The statistical proof is clear and convincing that repeat takers continuously do poorer on the bar exam than first time takers. Here are the hard facts:

The Pennsylvania February 2013 bar results indicate that the first time takers passed at an 72%. The second time takers pass rate was 57%, the third time taker pass rate was 53% and the fourth time takers passed at 24%.

In Texas, for the February 2013 bar exam results, first time takers passed at an 81% rate, while repeat takers passed at a 36% pass rate.

In Massachusetts, for the February 2013 bar results, first time takers passed at a 73% rate, second time takers passed at a 62%, third time takers passed at a 39% rate, fourth time takers passed at a 40% rate and 5th time takers or more passed at a 15% rate.

These statistical repeat taker numbers are a clear representation that repeat takers, on an average, only pass the bar exam at about a 33% rate. Obtaining a bar exam tutor should be the number one goal for all repeat takers.

The February 2013 Bar Exam Results: Maryland Bar Exam Results Have Been Released

Maryland released its bar exam results at 4:30 pm on Friday. The Board of Bar Examiners has listed the pass/fail list by numbers. Congratulations to those who passed.

Interestingly, and rarely seen by a state’s board of bar examiners, is a mea culpa from Maryland. Apparently, an error made in question 2, just about blew up the whole question for the applicants. Here is what they said: “Question 2 of the February 2013 General Bar Exam, testing Maryland Civil Procedure, was found to be confusing because of a conflict between the Question as printed (which referred to procedures in "District Court") and the Extract (which referred to procedures in "Circuit Court"). Because of this conflict, the Board, in the interest of fairness assigned the highest raw score of 6 for that question.” Can you imagine making that kind of mistake – and the students trying to answer it by using federal law when the examiners wanted local law? Now, that was a pretty grievous mistake. Perhaps they should have thrown the entire question out. It makes us wonder how many mistakes are out there and the states’ board of bar examiners haven’t admitted it?

The February 2013 Bar Exam Results: Texas, New York, and Indiana Bar Exam Results Are Released; Maryland to Come Out Today

Texas has released the names of the successful applicants. The overall pass rate was 74.2%. The first time taker rate was 80.7% and the repeat taker rate was 63.6%.

The pass rates of the law schools are:

Baylor: first time taker rate 95.6%; repeat taker rate: 83.3%
St. Mary’s: first time taker rate 75%; repeat taker rate: 66.7%
South Texas: first time taker rate 85.2%; repeat taker rate: 58.3%
SMU: first time taker rate 73.1%; repeat taker rate: 80 %
TSU: first time taker rate 66.7%; repeat taker rate: 63%
U of Houston: first time taker rate 89.7 %; repeat taker rate: 70.4%
U of Texas: first time taker rate 86.4%; repeat taker rate: 66.7%
Texas Tech: first time taker rate 95.5%; repeat taker rate: 63.6%
TWU: first time taker rate 88.7 %; repeat taker rate: 66.7 %
Out of State: first time taker rate 65.8%; repeat taker rate: 57.9%


The New York bar exam results for February 2013 has released the names of the successful applicants for public lookup today. The statistics are:

New York ABA Schools - First Time Takers 73%;
Out-of-State ABA Schools - First Time Takers 76%;
All ABA Graduates - First Time Takers 75%;
Foreign-Educated - First Time Takers 36%;
All Foreign-Educated 30%;
All First Time Takers 64% and
All Candidates (First Time Takers & Repeaters) 50%


The Indiana bar exam results for February 2013 has also released the names of the successful applicants, on its website. The statistics have yet to be released.

Maryland will release its bar exam results at 4:30 pm today.

The February 2013 Bar Exam Results: New York Bar Exam Results Will Be Out Tomorrow

The New York BOLE has updated their front page with this announcement:

The results for the February 2013 New York State bar examination will be released on May 2, 2013. The results will be sent to the candidates by email to the address on file with the Board. Please note that there may be some delays in receiving the email depending on volume and security issues with individual email providers. The results will also be available to the candidates by using the private lookup link that will be available on this site on May 2. The public list of the names of the passing candidates will be available on this site on May 3, 2013.

NO FURTHER INFORMATION REGARDING THE TIME OF RELEASE IS AVAILABLE. DO NOT CALL THE BOARD OFFICE.

Today is May 1st and we still have many more states that have not yet released their bar exam results.

This week, Texas and Maryland have scheduled the release of their bar exam results on Friday, May 3rd. Indiana is getting ready to come out on Thursday, May 2nd.

My students in New York and Michigan are getting very impatient. Both New York and Michigan have indicated that the bar exam results will be released in Mid-May, although in some years, both Michigan and New York have been released earlier. There is a rumor pending that New York may come out later this week, perhaps even on Thursday.
