The February 2013 Bar Exam Results: Massachusetts Bar Exam Results Statistics

Massachusetts’ applicants received their results by email last weekend and Massachusetts has just posted their statistics. A total of 671 applicants sat for the February 2013 bar examination, of whom 425 (63.3%) passed. There were 354 first time takers, of whom 259 (73.2%) passed the exam. The second time takers passed at 61.7%; third time takers passed at a 38.9%; fourth time takers passed at 40% and fifth time takers or more passed at a 15.4% rate.

By Law School, the statistics are as follows:

Boston College: first time taker: 87.5%, overall: 69.2%
Boston University: first time taker: 87.5%, overall: 83.3%
Harvard: first time taker: 100%, overall: 100%
Massachusetts School of Law: first time taker: 62%, overall: 51.6%
New England Law: first time taker: 61.5%, overall: 64.6%
Northeastern: first time taker: 88.2%, overall: 81.8%
Suffolk: first time taker: 70.5%, overall: 64.2%
Univ. Of Mass at Dartmouth: first time taker: 57.1%, overall: 52.4%
Western New England: first time taker: 40%, overall: 37%
All other schools: first time taker: 80.5%, overall: 67.6%

The Bar Exam Results for February 2013: Washington and Massachusetts Bar Exam Results

Washington has now publicly released the names and statistics of its bar exam results. 247 candidates passed the Bar Exam administered in February 2013. Of the 421 candidates who took the exam, 58.7% passed. First time takers (non-attorneys) passed at a 67.3% rate. Repeaters (non attorneys) passed at a 60.9% rate. Washington will be a UBE state.
Congratulations to those who passed.

The Bar Exam Results for February 2013: Virginia Bar Results Are Out, Oregon, Ohio Alabama and Washington Will Come Out Today

Virginia’s bar results have come out yesterday. Virginia's first time pass rate was 65.7% and its overall rate was 57.45%.

The law schools' first time taker pass rate was:

Appalachian: 25%

William and Mary: 50%

George Mason: 90%

Liberty: 100%

Regent: 66.7%

Richmond: 45.45%

Virginia: 100%

Washington and Lee: 57%


We have at least four states releasing their bar exam results today.

Oregon, Ohio, Alabama and Washington’s bar exam results will all be coming out today on Friday, April 26th. We will post the results as they come out.

Florida Bar Exam Results for February 2013: Why Do Law Students Fail the Florida Bar Exam; How Can I Pass?

Most law students fail the Florida Bar Exam for three major reasons:

1. They revert back to bad writing habits developed in law school.

Under the pressures of the bar exam, many students revert back to bad habits. These bad habits allowed them to graduate from law school, but will be the kiss of death on the bar exam. Some of the bad habits include, not organizing your answer, no line by line analysis and not answering the call of the question. Remember that the bar exam essay is completely different from your law school exams. You must organize, find your issues and discuss the issues fully to be successful on the bar exam.

2. Poor Preparation and Time Management.

Many law students start their bar preparation entirely too late, leaving most in a rush mode. For the upcoming July 2013 bar, your preparation should start no later than May 15, 2013. You should allow yourself 5 to 6 hours per day for studying. But more importantly, studying correctly is the key. You need to write and answer many essays and MBE questions. Your answers must be evaluated by a private tutor. The tutor can answer questions and assess your progress. Be focus driven towards your goal of passing the bar exam.

3. They don’t really believe that they will pass

You must have a belief that you will pass. Get rid of all negative thoughts, people and things. You must truly believe that you will pass. You must say this every single day prior to the bar and you must have the confidence to succeed. Although you have taken the bar exam more than once, you must know that you can pass.

The Bar Exam Results for February 2013: Minnesota, Oklahoma, Oregon, Virginia, and Washington

The Florida Bar Exam Results for February 2013: Important Advice for Repeat Florida Bar Takers

We have been talking with students all last week. The questions we’ve been asked more frequently is “what should I do if I was unsuccessful on the Florida Bar Exam?” First, let the shock of failing the bar subside with a few days of reflection. Clearly, this may be one of your greatest disappointments, but don’t let it control or define who you are. You can pass the bar exam in July 2013. Get right back up and say, “I will pass in July 2013.”

Ok, now let’s start. Do not repeat the same class, study plan or approach you used the last time. It did not work. Coming close on the bar is good only in horse shoes. One size does not fit all. Hard work and having a study plan and study strategy will pay off. Say to yourself, “I will be a lawyer.”

You want to get the bar exam behind you and start your new life as a lawyer. Don’t dither or waste time with the “what ifs”. Stay focused and true to your goal to pass.

The February 2013 Florida Bar Exam Results: The Grading

The Florida bar exam results have come out and most of the applicants have gotten their letter telling them the breakdown of the scores. Here is the way the grading is done in Florida.

Grading the Florida Bar Exam

The MBE & Florida sections are weighted equally on the Florida Bar Exam. This is called the “overall method”. (Rule 4-25(a)). A combined weighted score of 136 is required to pass the Florida Bar Exam. It doesn’t matter if your score in one section or the other is below the 136 – it’s the average score that matters. So basically you can fail the FL or the MBE section and still pass the FL bar exam if your overall score is at least 136.

If you fail one section of the bar and choose to re-take only that one section in the next examination, you must score the 136 points or higher on that section. The Florida Board of Bar Examiners calls this the “individual method”. (Rule 4-25(b)). Your chances of passing are slightly lower than re-taking the entire bar again.

If an applicant attains a passing scaled score on only 1 part and elects to take the overall method of the General Bar Examination as described above, the previous passing status will not be replaced by a failing status if the applicant fails to achieve a passing score on a subsequent submission effort. (Rule 4-25.1).

Each examination paper produced by an applicant on the General Bar Examination will be separately graded. The scores of each section of Part A will be converted to a common scale by a recognized statistical procedure so that each section is equally weighted. The sum of the converted section scores is the total score for Part A. All total scores attained by the applicants on Part A are converted to the same distribution as their Multistate Bar Examination (MBE) scaled scores. MBE scores (Part B) are the scaled scores on the MBE provided by the National Conference of Bar Examiners. Scaled scores are used in order to ensure that the standard of measurement of competence from examination to examination is not affected by the difficulty of the particular test or the ability of that particular group as distinguished from the general population of applicants. Rule 4-26.1

On the Florida portion of the bar, each essay is worth 100 points for a 300 point total. The multiple choice questions are worth 100 points total, so each question is approximately 1 point each. There are usually 10 experimental questions. The average essay score is around 40 points, requiring you to get your remaining points on the multiple choice questions.

Depending on the difficulty of the essay question and the average grade, the Board of Bar Examiners may adjust your score either downward or upward. There is a school of thought that a bar taker should hope for a difficult question so that the average grade is lower – thereby requiring the Bar Examiners to adjust upward. If the essay is an easy one, usually the average score is higher, thus requiring a downward adjustment. The Board does not adjust the multiple choice questions – there are what they are and the point totals do not change.

The February 2013 Bar Exam: The MBE Analysis

We have seen from both Illinois and Missouri how the MBE has “shaken” out for the February 2013 bar exam.

The average raw score for the MBE subjects is:

Evidence: 19.03 out of 33
Const. Law: 19.17 out of 33
Property: 19.63 out of 33
Contracts: 20.06 out of 34
Criminal Law/Pro: 20.07 out of 33
Torts: 21.25 out of 34

I have put the average raw score in order of hardest to easiest. As we can see this February, 2013, the hardest subjects were evidence and constitutional law; the easiest subjects were criminal law/procedure and torts. It is a surprise to see constitutional law as one of the harder subjects. In addition, from what my students told me, property did not have many future interests or mortgage questions, which was a great relief to many and pushed property into the middle range of the subjects (when it usually the hardest subject).

The average range for all the subjects is from 58% to 62.5%. These are the numbers you should be reaching when you practice your MBE questions.

It appears that the scaled score this year fits within the usual range of 12-15 extra points, depending on where you fall. That is consistent with prior years.

The wait is almost over, tomorrow is the day for bar exam results coming out of Florida. The Florida bar exam results for February will be released on April 15th. The results come out in the morning, around 10 am, give or take. This will be a day of joy for some and difficulty for others. For those who pass, enjoy this exciting and great accomplishment. The February 2013 Bar Exam Results: The Long Weekend Wait for the Florida Results

The Florida Bar Exam Results for February 2013 will come out on Monday, April 15th. There is no magical time it comes out, although the results usually come out around 10 am. The results came out around 9 am one year, another year, around noon – so anywhere around 9:30 to 12 noon is your window to keep hitting the refresh button.

Florida releases the numbers, not the names of the applicants and the site reveals just pass or fail of both Part A (the Florida section) and Part B (the MBE section) and the overall pass or fail. When you look up your number there will be 4 columns: your number, pass, pass, pass. The last pass is your ticket for your law license. You can fail a section of the Florida bar, and with enough carry over points, you can pass overall. So you will see some scores, like fail, pass, pass or pass, fail, pass. That’s ok, because that applicant has passed the Florida bar exam. Look at the final column and you’ll know whether you passed or failed.

The Florida Board of Bar Examiners also releases the passing rate of the law schools, too, later in the afternoon. The Florida Board of Bar Examiners releases the passing rate of the law school to the law school first. Later that day, the Florida bar examiners then releases the passing rate of the law schools to the public. Florida only releases the first time taker rate and not the repeat takers rate, and not the overall pass rate. It’s unfortunate that Florida does not practice full transparency, because I have seen quite a few law schools who try to fudge the overall rate and the repeat taker rate to something higher than what it really is – then tell their students who have failed, that all they need to do is keep taking it and they will eventually pass. I have seen students taking the exam 6, 8, 10 times. We know you need a bar tutor to help you get over the finish line.

The February 2013 Bar Exam Results: Florida Bar Admission

Back in October, we reported the story of the undocumented immigrant who has been in the United States since he was 9, went to law school and passed the bar exam. The Florida Board of Bar Examiners asked the Florida Supreme Court to issue an advisory opinion as to whether undocumented immigrants should be admitted to the Florida bar. It turns out that the lawyer for the Florida Board of Bar Examiners asked the wrong question. Any first year law student should know that it is suicide to ask such a broad question. For example, look at the cases before the Supreme Court during the civil rights movement – and the abundance of civil right cases decided before the Supreme Court. It was one step at a time, instead of an over-broad opinion, i.e. can African-Americans eat at a restaurant, can African-Americans stay at a hotel, can African-Americans ride a bus, can African-Americans go to state schools for college, for law school, etc.. All of those cases were one small step until, finally, after dozens of cases, did the Supreme Court issue the order we were all waiting for – we cannot discriminate against our citizens at any time or any place.

Here, the lawyer for the Board of Bar Examiners asked for an advisory opinion of all undocumented immigrants instead of asking about this one undocumented immigrant. Here is what the Florida Supreme Court ruling said: “ The "Motion for Admission," filed January 16, 2013, is hereby denied. In this cause, the Florida Board of Bar Examiners has petitioned this Court for an advisory opinion regarding a clearly stated question. The separate issue of the individual movant's admission is not before the Court.” That was the total opinion. What a waste of time. Of course, the papers are full of stories about the opinion being a denial of admission – but we know better, because we, as lawyers, actually read the opinion.

Whether you are for or against the admission of undocumented immigrants to the bar, one thing is certain, the lawyer made a fundamental mistake in asking for a broad ruling, instead of the specific one that needed to be answered.

North Carolina and Illinois have both released their bar exam results.

North Carolina released their results on Monday and today, Illinois has joined the early release states and has informed their applicants of the results.

The February 2013 Bar Exam Results: North Carolina, Illinois and Wisconsin Bar Exam Results

Today is April 1st and we are still waiting for the results from the states with early release dates. I’ve been told that Wisconsin results came out late last week – Wisconsin wins the first to release states this bar exam cycle. Hopefully, North Carolina will be mailed out today. Illinois indicated that their scores would be released soon, too. I’ll let you know when we get more information.
